Paying for Cell C's incompetance

Cell C sold me a contract telephonically and delivered my device. Supp**** them with gps coordinates of my location and they assured me service. Since the first day of receiving the device in November i have had problems. After numerous complains since then they have admitted to not having service in my area and is prepared to cancel my contract but want me to pay R16000 for the device which is not like new anymore. I can understand that, but they should not have sold me the contract in the first place and took more than two months to figure out where they dont have service. I have voice recording of them confirming they have service in my area which they now admit they dont, and of all my correspondance with them. I am not paying R16000 for their mistake and want to be refunded for paying for a service that doesnt exsist. It should be fair to be reinbursed for the inconvience and additional cost incurred to get service from other networks to prevent loss of business from having an incompetend network during my period of agreement. What can i do?

To further insult me, Cell C has offered me a goodwill refund of R999 of my next bill of R1700. Even the representatives from CellC admit that they also would have been unhappy if they where treated in the same way. But are unable to do anything. All they can do is appologize. I see no goodwill, only unWILLingness to sort out their stuffup. I cant understand how big companies are able to get away with trapping consumers in contracts and not deliver on the agreements they made. I wish the people in the Cell C adds was wearing balaklavas, so atleast somr people, including me would have known not to take their word and trust them. I know and have heard of so many people that feel the same and the sad part is most of them eventually give up fighting with Cell C and eventually just cut their losses, get another network, and wait for the contract to expire.

When we received your review on this platform, we acknowledged it with the aim of rectifying and resolving the matter amicably as we do for all our customers.

As per our records, you were offered a one-month free subscription fee which you rejected and opted for a cancellation. The consultant advised that the matter is still under investigation and you insisted on canceling the contract. The consultant advised that you would have to pay the settlement amount or wait until the investigation is done.

She further advised that you should rather wait until the investigation is done and if the outcome feedback confirms that the issue is network related then the contract can be canceled at no cost then you would have to return the handset and all the accessories or can pay the settlement amount and keep handset.

I assume you have voice recordings of your statement, because i do. I was not advised that the investigation is still in progress. Last time i was advised on an investigation was approx a month, maybe even more ago. I was then told the network department would need a week for the investigation. I was told by a consultant that the service in the area is not good. If i was told that there is adequad service in my area when i called cellC upon which i decided to port my number and get a contract. Why did i have to struggle with service, pay extra for an alternative provider and have to pay for a service that i was promised while CellC performs an investigation om service i was promised to receive. I complained from the first day you delivered the handset. You have had ample time to rectify the problem but its been months. I am not paying for a handset since ill get a new device with a new contract from another service provider. How is this amicable ˈ(amɪkəb(ə)l/Submit adjective characterized by friendliness and absence of discord. "an amicable settlement of the dispute") ?
