No repairs done on damaged phone

Last year in Feb, I got a new, white blackberry and after a couple of weeks I realized that one of the buttons was not working well, I took it to a Cell C outlet in Maponya Mall, waited for two weeks and was later notified that my phone was back from repairs. When I went to collect the phone, the assistant at the shop told me the phone had a factory fault and I would get a replacement phone - this one was black but same model. The unfortunate part was that, this replacement phone was a REFURBISHED phone. This phone lasted a couple of moths, I realized that the battery was getting weaker, I bought a brand new original battery still from Cell C, the phone kept on having multiple problems ranging from a weak battery, not charging, not taking the sim and micro SD card and eventually dying on me after buying a SECOND original battery. In on the 25th of July 2015 I took back the phone to a Cell C outlet in Jabulani Mall, it came back unfixed because IT WAS OUT OF WARRANTY, so this assistant tells me the phones have 1 year warranty, but I'm still paying for it and what upsets me is that, it was a refurbished phone that I have no idea how long it had been used. this is against the CPA.
