New phone issue

I took a new contract for the Huawei P Smart with cell c Pavilion on 16 June 2018. At the time the sales consultant advised that if I have an issue with the phone within 7 days I can bring it back and they would replace it. Anytime thereafter would be sent for assessment and depending on the problem found it would be repaired or replaced. I have been having issues with the calls over the week with the phone. I can hear the person on the other end however they cannot hear me-roughly 70% of the time. Took the phone back today, 22 June 2018 and was advised that they would need to send the phone for assessment as the 1 test call seemed to be ok and that it may just be a network issue. I was using the same sim in my old phone and had no issues with the network, get a new phone now there's a possible network issue. I told the consultant that the sales consultant (1) who assisted in the contract said it would be exchanged if within 7 days however consultant 2 said this not policy and then explained the procedure. I said that they should be upfront on the complete policy when we are taking the contract and not when we have an issue. Sales consultant 1 then said he explained everything to me last week and basically that's the policy and I signed their contract. I was then advised it would take 7-14 days for assessment. I queried about a loan phone and was advised that they don't have one. I then queried if I could cancel the contract as I cannot be without a phone. I was advised that I couldn't. So at this point my patience is running out and said to the consultant I took a contract because my phone broke. I have an issue, you say I can't get a replacement, you cannot give me a loan phone, you cannot cancel my contract so I'm expected to be without a phone for 7-14 days and still pay for a contract that I cannot make use of. His response was let's not blow this out of proportion in which I responded that I am not and put yourself in my position. He then advised that he will get his manager. After waiting about 10 minutes or so the consultant came out and said he had a phone but requires a different type charger which I don't have. After some time he then brought a BlackBerry and I signed for the loan phone. He put it back on charge at the back office. We waited again for about another 10-15 minutes. Hubby asked him to bring the phone as we can charge it at home and were then advised that there was an issue with the phone and they are now checking the third phone-all of which had flat batteries. Hubby requested to see the manager. Someone came out who was not the manager, never introduced himself, advised that the manager isn't in and then started to explain the issue to us and that they are doing their best however had a bit of an attitude. I said it's unacceptable to make us wait for 30-45 minutes. First there is no phone then they find 3 phones and all are flat. This acting manager then tells us they are trying to get us a phone that works as they understand I cannot be without a phone. I asked him, if they understand the importance of loan phones why do they have faulty phones and why are they dead? To which the guy responded that they did not give out a phone this week and are just ensuring that we leave with a phone that is working and If he was a customer he would wait to ensure he is getting something in working order. I said it's easy for you to say this because you are on the other end. This person could not grasp what I meant. He is quite clearly not fit to stand in for a manager as he has no customer service s****s. You cannot make a customer wait for so long with no apology, limited communication on what's causing the delay and then stand there and talk to us as if you are doing us a favour and expect us to be patient with your branches inefficiency. Absolutely disgusted at the service received from this branch and would never sign a deal with them again. They mislead customers and then blatantly deny it and refer you to some piece of paper that they don't even give you a copy of. Let's be honest, you explain the T&C's to us and stick the page infront of us and say initial at the bottom/ sign here. 99% of clients don't go through that with a fine comb and take your word for it. I now wait to hear if they are going to repair/replace my new device which I believe is completely unacceptable. This should have been replaced as verbally advised. It's unfair that you even consider repairing a brand new phone!
