False advertising

<p>For the last two months Cell c brochure that comes out with specials are advertising the Apple I phone Se on various contracts. Since the advert has come out up until now they still do not have stock and give no alternative measures. They have never had stock so this is classified as false advertising. Cell c just pulls there shoulders up and continue to advertise goods without having or had stock. Legal action needs to be taken. How can they advertise if they have not had the phones in there possession.</p>

After receiving a message that someone will call and help from cell c two days later still no success. Today I received a call from cell c upgrades informing me that I can upgrade and on asking them I want a iPhone Se as they advertise I was told by the lady that yes they have stock. I asked her more than once is she sure there is stock and she confirmed every time there is stock. I asked her how is it possible. She had answers for everything until I asked her about the advertised contracts that she called her supervisor. When I asked her about stock she all of a sudden said there is no stock. She said the lady that spoke to me was a trainee and did not know much. She further informed me that the advertised prices and contracts are only for the period advertised. Opposite to what was told to me that if I placed the order they need to give me the advertised deal. Looks to me no one at cell c really knows what is going on. They further speak different info but yet they all work at the same department. Even the people who got back to me after my first posting did and still haven't addressed the problem. They want to give me a total different phone on different contracts at double the price of what they advertised. My question is how can they continue to advertise falsely and just getaway with this. Surely this can be addressed and cell c be forced to in such a case give an alternative phone at the same cost. This was clearly told to me that they will not do this, You cannot win. Its like speaking to a brick wall.

Firstly I was not contacted on the same day. It was the day after and secondly I did not say anything about that. I said two days later and still no success. Just as you read things that aren't so you are handling the problem. All you do is ignore the problem at hand and address things around the problem by giving me other phone on a different contract and at a much more expensive payment. Focus on the issue at hand. You are falsely advertising products and continue to do this without providing alternatives to the advertised contracts. Let me spell it out to you. You advertise that on a epic 200 plus a iPhone Se and a trade in the contract price is R329.00 per month. You Dont have and never have had stock so the right thing to do is to say as a result of falsely advertising and as a result of our in house problems we are willing to give you on the same contract a iPhone Se 64 gig or iPhone 6 just to keep our side clean and to show that we take responsibility for our actions. But no you continue to make as though you have never advertised or had such a deal. Yet you continue to once again in the new pamphlet advertise the same phone knowing well you Dont have stock. This is unacceptable and cell c needs to take action with regards to this. If you can't sort this out then please give me the contact details of who I can start talking to about legal proceedings as you legal department is not existent or they are also on cell c network and they are unreachable. I can't believe that cell c will be willing to go on a legal battle which could cost a lot of money as a result of two phones.

Once again you focus on matters of no concern to the problem. Focus on the problem of false advertising. Strange how when you need proof of things how you can get it but when I say you have contacted me then all of a sudden there is no proof even if when we start conversation it gets said all calls are been recorded but again I say nothing has been done. Focus focus on the problem not on petty issues of when was phoned or not. The problem is still there and not been a dressed.

This is a matter of concern because on the very same day you logged your complaint the consultant addressed the problem and advised you accordingly.

The advertised deals on the booklet are subject to the T & C's and to stock availability.

You say that I was advised accordingly. Seeing that you know everything what was I advised? I'm glad you say terms and condition apply and availability of stock but THERE WAS AND STILL IS NO STOCK. What Dont you understand. Answer the question at hand. HOW CAN YOU ADVERTISE SOMETHING YOU HAVE NOT HAD IN YOUR POSSESION AND STILL CONTINUE TO ADVERTISE THE SAME PHONE KNOWING WELL YOU HAVE NO STOCK. No where the terms and conditions cover you for false advertising. There is a board which controls this and is taken to be a serious matter. You continue to address issues you feel you have answers to but for a moment focus on FALSE ADVERTISING or must I seek legal advise? You need to train your operators to say the same things you are saying because that which they say and sell differs from every operator. This I have proof of. Your rules apply only to you and to the forum we are on but contact your upgrades or whatever you hear a total different story. For example. I was told by operator that if I've app**** for this phone within the period as a result if no stock received and awaiting stock they have to give me the phone on the contract advertised. If you would address the problem and make an effort to solve it well be able to move on. I further asked you to give me the contact details as to who I can discuss legal proceedings but as usual you read and answer what you want. I make a plea to anyone else reading this to assist with details who I can contact so as to start with legal proceedings as this seems the only way forward.
