Failure to comply with CPA

I have recently renewed my cellular contact with the telecommunications company known as Cell C and upon receiving my brand new device the Sony experia m4 aqua I was told that the phone comes with a warranty android my knowledge and in terms of the Consumer Protection Act 68 of 2008 a warranty for all purposes will be deemed to be a repair or replace warranty meaning that should a product not be able to be repaired it will subsequently have to be replaced. I just about had my new device for thirty or more days without any negligence on my behalf and the device's power button seized to function along with both volume up and volume down buttons. Furthermore the device would overheat and would not respond to the charger at all. When I then called cell c to inform them of this defective unit they have supp**** me they then told me that they will attempt to repair it and if this is not possible to do they will return the device to me broken and I will have to continue to pay my contract as normal. This is obviously in clear violation of the Consumer Protection Act and a breach of contract which I will not stand for. Should nothing be done about this I will take this to the highest level
