Good afternoon

Im very frustated with Cell C at the moment. Ive been a customer with Cell C for close to 8 years now. Ive been under debt review for the past 5 years. Cell C did upgrade my contract before while being under debt review. All of a sudden Cell C changed there rules.

Ive contacted your head office and was told to go to a store which I did do. I went to Cell C, Keywest. Joseph Malema was really trying to help me. He knows me because he previously assisted me with upgrades.

Ive settled all my accounts which confirmation letters from my creditors was send to you confirming this. Debt rescue also issued a letter confirming that all accounts are settled and also giving permission that I can do a upgrade. The letter also states that they are in the process to finalise the clearance certificate. Even with all this documents Cell C is not prepared to help me.

As mentioned before I am a customer for more than 8 years and did not default once in all these years. Clearly this also doesnt mean anything. I have 2 contracts with Cell C and the.upgrade amount for both contracts is going to be R630 where at the moment Im paying more than a R1000. I really dont think that Ive been treated fairly.

Just to mention that MTN and Vodacom is prepared to assist me with a contract with these letters.

Surely there must be something that you as the manager can do to assist me.

Im attaching the letters again.

It would be highly appreciated if you can look at my file again and reconsider your decision.

PLEASE SEE THE CORRESPONDENCE BELOW FROM A LAWYER REGARDING CELL PHONE UPGRADES.
A cellphone contract is considered to be a service agreement - not a credit agreement. As a result, it is generally not part of the debt counselling (or debt review) process (unless the consumer is in arrears with their cellphone contract, in which case the cellphone contract could become part of the process). In this case, given that the consumer is still enjoying a cellphone contract, they are probably not in arrears, and therefore the cellphone contract is being paid by the consumer outside of the debt counselling process.We further assume that the cellphone contract the consumer is paying towards is budgeted for as part of the debt counselling process, and that their new upgrade will not cost significantly more than what they were paying previously. If so, our view is that since this is merely an upgrade, the consumer should have no problems in trying to upgrade/update their cellphone contract.On the other hand, if the consumer will pay significantly more towards the upgraded plan, then they would need to discuss this with their debt counsellor to make sure their budget caters for this additional amount. The cellphone provider may conduct a credit check and would potentially become aware that the consumer is under debt counselling – however, since there is already a contract in place, this should not become an issue with the consumer. From time to time, we come across consumers who want to rent a new apartment while under debt counselling – a similar situation to cellphone contract.In those cases, the debt counsellor could provide the consumer a letter confirming that they are under debt counselling and are maintaining regular payments. So, for any avoidance of doubt, we would advise the consumer to take along such a letter when trying to upgrade their cellphone contract.

Just received a call from Cell C. Still not prepared to assist a loyal customer of 8 years with a upgrade because my debt review status is not been removed yet. Even after I gave them letters from all my creditors confirming that all my accounts are settled and a letter from Debt Revue confirming this. Beware before you take out a contract with Cell C.
