Cell C Refusal to Cancel Contract
Good day, I am encountering belligerence on the part of one Cell C store manager at Westville Dawncliffe, Durban who refuses/refused to accept custody of a router having been advised of my intent to cancel contract of sale entered as at the 4th of March 2020. Gentleman by the name of Jesian Naidoo[first name as per name badge, last name by his word] at Westville Cell C identifies himself as the last line of communication at the store and his position as follows is the official position of CELL C as an entity in its entirety.
Sunday the 8th of March 2020, I made a call to customer services who then advised to call back on Monday as cancellations/retentions is closed on that day. They advised me that the contract cancellation department only operates from Monday to Friday as at 7am with the number 084143
As per the above directive, I proceeded to make several calls informing them that I had entered into an agreement on 4th March 2020 for Cell Wi-fi Router with 10GB daytime and 10G night time data and wish to cancel it. Where I was then advised I was well within the parameters of a return as it still fell within the applicable time frame. I called 084143 To which I was linked to the contracts cancellation department who advised me that I can return the product as it falls within the 7 day period to return store products and that because it was an instore they cannot then assist I need to proceed to the nearest store of purchase it must be returned to the store and they cannot then refuse and would only be liable for payment for the data consumed thus far. I further explained that the router was opened instore by the sales consultant identified as Myran who activated the sim and router in store on Wednesday 04th March 2020 The masquerading manager at Cell C Westville then took a highly belligerent, aggressive, ********* stance, refusing to assist in furnishing reasons for his refusal in writing, refusing to assist in the cancellation procedure and customer education thereof, in addition he refused to assist in accepting notice of termination, further delaying and frustrating the process but rather insisting he be furnished with a ridiculous sum of money for reasons sp****ly explained at best and nowhere near logical not unlike a con artist’s quick pitch that has plenty wording but no depth yet his utterings were supposed to represent the official position and policy of the Cell C against my rights as a consumer in the backdrop of the Consumer Protection Act and remedial recourse available in the interest of all parties. Additionally, if you enter that particular store, there is nothing put up like every other branch that entails the steps for aggrievement, furthermore it does not display the cell c commitments in various official languages like the other branches do, this I believe to be no oversight but rather deliberate blindsiding and keeping customers in the dark only to stone wall them with at every turn of the engagement with highly unprofessional conduct bordering on an allegation I care not to disclose at this point in time as yet I have attempted to source the contact details of the regional office in Umhlanga and HQ in Midrand, fortunately I am between those two hubs quite often every quarter and I wish to escalate this matter of this particular cancellation in conjunction with the conduct of your representative, please also be advised, in addition to the recorded calls made to me to the contact centre, the repeated engagement with the pretender Manager, this also serves as further continued due notice of my cancellation of agreement entered into as at the 4th March 2020. I wish to cancell and ternimate this contract with incredible urgency in the interest of settling this troubling matter by way of email correspondence preferably and secondary form by telephonic correspondence. I wish to additionally note that a Gentleman emerged from the back office, senior fellow with management trousers and shoes, the conduct of Jesein then changed immensely to one of at least an employee at work at best yet there was no intervention beyond eavesdropping and mouse moving from this said individual, who summarily slipped back into the concealed office not to be seen again. All these individuals I am in position to positively identify with cer*****y. I do not believe it is appropriate for an employee to present themselves as the store manager in the presence of the store manager, yes de-escalation is essential but at what point do those representations then border on ********? Or negligent or intentionally not of assistance in furtherance of strong-arming tactics seemingly unique to this branch and these individuals.
Please shed light on all these concerns, I am ashamed to admit they have plagued me of my sleep, and I wish for the matter to be put to rest. I have called the call centre I’ve been in store I’ve done as directed when fortunate enough to be directed and you will see on the customer account notes the number of engagements if logged by these people at all. Jesian gave me the email address *** is that an appropriate directive, I trust this fellow no furtherer than I can throw him.
Lastly, and I do profusely apologise for the extended correspondence but as you can imagine this matter is quite troubling in its continued complexity, the masquerading manger jesein said he sent an email to Head office advising that I had dropped off the router yet refused to give me acknowledgement of taking custody of the router and refused to supply me with the email he allegedly sent citing internal memo procedures. As stipulated previously in may calls and email correspondence to Cell C customer Services , the reason for contract cancellation was that I was given and advised on false information regarding the data package that was propmoted to me. As an aggreived customer i proceeded to call customer service who advised that I was well within my right to cancel as it was within the 5 day grace period and should proceed instore to return the router. When I arrived in store I was dismissed by both store manager and consultant and told the Cell C's officail position is that once a customer opens a contract through cell C it cannot be cancelled .
I have evidence of numerous corresponce with Customer Care reference and case numbers, the last one bieng that Cell C's position is to refer me back to customer care as a starting point due to "insufficient information". Had a shred of due diligence been done you would find a mountain of correspondence stemming and escalating from the very place they now defer me back to and it's unthinkable that Cell C would actually attempt to palm me off in such a disgusting manner. I wish not to believe the result of internal escalation resolution processes of CELL C culminates in the response they have furnished me with but that too will be questioned whether it's your own incompetence and dereliction of duties or that's the belligerent posture of CELL C as company policy.
