Cell C reckless Credit
In October 2016, I happened to be at a cell c store in Musgrave Durban perusing specials as I was interested in purchasing a cheap phone for cash (R2300). A sales agent approached me and advised me not to "take a stupid cheap phone" but rather instead take a good phone on a cheap contract. He showed me a deal for a Huawei P9 lite on Pinnacle 100 for just R249. I was very interested but asked about the cash price since I'm a University student and unemployed, therefore to my assumption not eligible for a contract. I explained and he still continued to ask for my ID number to see on his system if I qualify. I didn't have my ID on me that day so he asked if I knew my parents ID numbers. I happened to have my mother's ID number on a University indemnity form that I had in my backpack at that time. I gave it to him and he said it doesn't qualify for this deal. He said I must return the next day with my dad's ID number and he'll "make a plan". The next day I arrived and told him that I find using my father's ID number for a contract without his permission to be beyond what I'm willing to do. He then advised me to sit and wait a few minutes, as he was busy with another client. When he did see to me, he asked me for my ID. I had no problem giving him mine since I knew I would instantly be declined for being a student. He checked and for some reason, I qualified conveniently for all deals upto a cost of R250 pm. He then asked me what color device, what storage and so forth. He pressured me into taking 2 deals despite the fact that I only need one phone. He said I can "sell the second device and make some money for myself while just paying an extra R250 for it, and that's how I can pay for my contract, by selling the second device. I asked why is he forcing me to take 2, he said it was an excellent deal and a win-win for both of us, money from the sale of the 2nd phone for me, and a commission from cell c for him. I insisted on not taking 2. He then told me not to worry about proof of income. He said I must go upstairs and open a bank account at nedbank and he'll handle the rest. He took the name of a relatives supermarket, address, etc, and without the company's permission, made a payslip for me. He then said to go back to the bank and request a 3 month bank statement despite that the bank account was now just a few hours old. I received the empty 3 month statement and he asked for it and began processing paperwork. He gave me a document to sign and hurried me to apply my initials to each page. Before I knew it, I was now an owner of a Huawei P9 lite with no way of paying for the device, as I've breathlessly explained to the overbearing sales agent. As an 18 year old, credit-illiterate, student, I feel that I should not have been coerced into a contract the sales agent knew I have no way of paying. Now I have been handed to a debt Collector for an outstanding amount of R6000 which could have been avoided if cell c did not force me *******ly into a contract. I wish to know whether there is any legal basis to have the outstanding debt written off. Thanks.

You have a right to say no, a sales person can never force you to take out a contract which you would be liable for. You could have easily walked a way in this situation as you have a right to accept or reject the offer.
