CELL C NEEDS TO BE HELD ACCOUNTABLE

WITHOUT PREJUDICE FORMAL LETTER OF DEMAND ******** CREDIT LISTING | BREACH OF CONTRACT | DAMAGES TO: The Legal Department Cell C 1. INTRODUCTION 1.1 We act on behalf of Mr Charles Daniel Elliott (“our Client”). 1.2 We address you pursuant to serious irregularities arising from your client’s conduct, including ******** credit reporting, defective account administration, and failure to resolve long-standing disputes. 1.3 This letter constitutes a formal demand and final notice prior to the institution of legal proceedings. 2. FACTUAL MATRIX 2.1 Our Client has maintained multiple mobile service accounts with Cell C over an extended period. 2.2 Notwithstanding timeous payments and repeated engagement, Cell C has: • Failed to reconcile accounts correctly; • Reflected accounts as outstanding despite proof of payment; • Failed to resolve disputes raised through proper channels; • Demonstrated a lack of internal administrative control. 2.3 Of particular concern is the following: 2.3.1 An alleged outstanding balance of R512 (Five Hundred and Twelve Rand); 2.3.2 Purportedly originating in or about 2017; 2.3.3 Which has resulted in an adverse credit listing against our Client. 2.4 The alleged debt has been formally disputed and remains unsubstantiated. 3. ******** CONDUCT 3.1 Your client’s conduct constitutes, inter alia: • The listing of disputed and/or unverified debt; • Failure to follow lawful credit reporting procedures; • Failure to investigate and resolve a dispute prior to adverse reporting. 3.2 Such conduct is in breach of, inter alia: • National Credit Act • Consumer Protection Act 3.3 The maintenance of an adverse listing for approximately eight (8) years is grossly unreasonable, disproportionate, and legally indefensible. 4. BREACHES Your client’s conduct amounts to: 4.1 Breach of contract; 4.2 Administrative negligence; 4.3 Failure to provide services with reasonable care and skill; 4.4 Wrongful and ******** credit reporting; 4.5 Conduct causing reputational and commercial harm. 5. DAMAGES 5.1 As a direct consequence of the above, our Client has suffered: • Reputational harm arising from adverse credit profiling; • Commercial prejudice affecting financial standing; • Loss of time and administrative costs; • Ongoing inconvenience and disruption. 5.2 Our Client reserves the right to quantify and pursue such damages in due course. 6. DEMAND You are hereby required to comply with the following within 7 (SEVEN) DAYS of receipt of this letter: 6.1 Immediate Credit Bureau Rectification • Remove the adverse listing from all registered credit bureaus; • Provide written confirmation of such removal. 6.2 Withdrawal of Alleged Debt • Confirm in writing that the alleged debt is withdrawn and/or cancelled; • Confirm that the listing was erroneous and/or disputed. 6.3 Full Account Reconciliation • Provide a complete, itemised statement of account; • Provide all supporting documentation substantiating the alleged balance. 6.4 Internal Rectification • Confirm that all internal records have been corrected accordingly. 7. FAILURE TO COMPLY 7.1 Should you fail to comply within the stipulated period; our instructions are to proceed without further notice with: 7.1.1 Formal complaint and escalation to ICASA; 7.1.2 Institution of legal proceedings, including claims for: • Damages; • Declaratory relief; • Costs on an attorney-and-client scale; 7.1.3 Applications for: • Interdictory relief compelling removal of the listing; • Appropriate punitive cost orders. 8. PRESERVATION OF EVIDENCE 8.1 You are hereby required to preserve all documents, records, and communications relating to: • Billing and account history; • Credit bureau reporting; • Internal communications; • Customer service interactions. 8.2 Any destruction or alteration of such evidence will be re**** upon in legal proceedings. RESERVATION OF RIGHTS 9.1 All rights are strictly reserved. 9.2 Nothing contained herein shall be construed as a waiver of any rights or remedies available to our Client. 10. CONCLUSION This matter concerns not merely a nominal amount, but fundamental legal compliance and accountability.
