Case handed over to the National Ombutsman. This is the letter sent to the Ombutsman..
Dear Sir/Madam
My wife and I upgraded our Cell C contract in January /February. The beginning of March the phone started giving problems but turning itself randomly on and off. I drove 220km to Polokwane, where we've upgraded to return the phone. They told me that the phone must be sent back for repair. After a couple of weeks they phoned me to tell me that the phone was fixed and it was ready for collection. I then drove another 220km to Polokwane to collect the phone. That same day, as I arrived back home, the phone gave me a error message saying that there was a software problem and must be returned to a service centre. I then drove all the way back to Polokwane to return the phone. I was phoned the next day and informed that they've fixed the phone. After about two days the phone started to randomly switch itself on and off again. I have spoken to many people at the Cell C customer service centre and was told on two occasions that after the third report of faulty devices that a new one was to be released. I was told that it would take 3-5 working days for the phone to be collected. After 10 working days, I phoned them to inform about the collection. Nobody was aware of my problem and I was promised by a lady by the name of Kgaogelo that she will talk to the person at the Polokwane store to solve the problem and she would get back to me in an hour. She never returned any of the calls. I decided to report this to Hello Peter. The response was quick and Nelly promised that she would resolve the problem. I was told that a courier will be sent to pick up the phone. I was under the impression that a new device would be supp****. I was absolutely furious to learn an hour ago that the phone would be picked up and taken back for assessment and could take up to 21 days. I am very sorry. This is a violation of my consumer rights and I demand for a new device. I was calmly informed that this was the way it worked. I cannot be sold a faulty device and struggle for months to get a proper service and phone. I must bargain the end of my deal, but Cell C isn't. I then told them that we must cancel the contract, and they calmly told me that that I was not possible. I cannot pay for a service which I am not getting. I told her that I will go to the bank and stop the debit order, in which she said that I would be handed over... I am incredibly disappointed and angry with their unprofessional behaviour. Please assist?!?!?!?
