Cell C does not comply to consumer protection act

On Saturday, 13 January 2018, i purchased a Nokia 6 from Cell C Somerset Mall on prepaid. Since yesterday Monday 15 January 2018 the phone started to get warm as applications were in use and the people who i spoke over the phone could not hear me.

On Tuesday, 16 January 2018 i went back to Cell C Somerset Mall where i purchased the phone and they refused to provide me with a new Nokia 6 cell phone or give me a refund on my purchase as i returned the Nokia 6 cell phone in its original packaging and with my invoice and proof of payment slip.

I was informed that the phone needs to be send away to Johannesburg for inspection which could take up to 21 working days.

I want to know why Cell C does not comply to the consumer protection act when i returned the phone within 7 days after purchase within in its original packaging and with my invoice and proof of payment slip.

Moses contacted me on Friday 19/01/2018 in the afternoon. He said that when i took the phone from the cell c shop on Saturday when i bought it, that i confirmed that the phone works. The phone was only switched on and then off in the shop to confirm that it works. The issue was never that the phone switches on and off, but that the phone gets hot when it is being used and the speaker is not clear when i phone family and friends to speak to them. No new Nokia 6 device was offered to me or no refund for the purchase of the Nokia 6. Now i need to wait for a week before i need to get in contact with Moses again to follow up what the situation is with my Nokia 6 because they need to inspect the phone and then send it back to the supplier which makes it now my problem. Still i ask myself how Cell C is complying to the consumer protection act when i returned the phone to the shop in its original packaging, with no scratches or damage with the invoice and proof of payment and hasn't been taken back in the cool off period. I will also be closing all my cell c contracts during the year when it expires. This service is totally unacceptable and big corporate service providers think that they can just bully their customers and get a way with it. Very dissatisfied and upset customer.

After one week of arguing and fighting i am pleased to say that i got my refund back from Cell C for the phone purchased. Case solved.
