Cell C does not abide by their own terms and conditions

My contract commenced on 1 June 2014. It should have ended yesterday (31 May 2016).

This morning I called the call centre to confirm this and I was told that I need to give notice and this is stated in the contract I signed. So I got the contract and took a look. It is correct that notice must be given; point 4.1 states that the agreement needs to be cancelled by giving 30 days’ notice. However, point 4.3 states that Cell C will notify me 40-80 days prior to the contract ending of the following: 1) date the contract will end, 2)any changes to the contract and 3)my right to cancel the contract.

This notification was never sent to me and I was told this morning the contract will now only end on 30 June 2016 and I will be debited for an extra month on the 30th of June 2016. If it had been sent to me then I would have obviously communicated the necessary cancellation to Cell C.

Why must I be penalised because Cell C did not comply with their own terms in their own contract? You put point 4.3 in the contract stating that I will be notified. I was not. Now you expect me to pay for 25 months instead of 24? The call centre agent tells me the contract cannot now be cancelled immediately.

I was never notified of my right to cancel the contract. I was not even aware the contract had to be “cancelled”, I was under the impression it would expire after 24 months since it was a 24 month contract.

Please give me feedback urgently.
