Cell C discriminating customers that are under debt review

I have been a client with Cell C for years and I am now due for upgrade. But as luck and circumstances had it I'm now under debt review, yet Cell C isnt part of the debt review - I have placed it as one of my monthly expenses which I pay monthly without fail. According to the debt review companies if you have placed it (your cellphone account) on your monthly expenses when you app**** for debt review, and you have proven that you can pay the account, then you are allowed to upgrade your contract, you are only not allowed to open a new contract. So, my question to you - why am I not allowed to upgrade? I did not ask to upgrade to the most expensive cellphone. I asked to upgrade within the same amount I've been paying, because I know I cant afford it, I'm not stupid. I know what I can afford and what not.... Please explain to me why you like to break the rules? You can see what I am able to pay each and every month when I pay my account - so why did you decline my upgrade for a 'simple' phone where I wont need to topup etc

It is company policy that once you are under debt review, then we don't allow for new or upgraded contracts.

It is in my understanding that according to the law of debt counselling cellphone contract is considered to be a service agreement - not a credit agreement. As a result, it is generally not part of the debt counselling (or debt review) process (unless the consumer is in arrears with their cellphone contract, in which case the cellphone contract could become part of the process). And in my case, I am not in arrears hence my cellphone contract is not included in the debt review. My cellphone contract included in my monthly expenses instead.

Your policy is discriminatory to your loyal customers and it is against the law. I am quite disappointed.
