Cell C Contract ****
Cell C continues to debit my account *******ly. They forcing me into a 24 months, which I clearly didn't agreed to per the call recordings.
I had a 24 months contract with cell c that came to end in June. I got a call to upgrade it on the 28 March. I refused to take a device and opted for a month to month contract with the same benefits. I explain that I wanted flexibility since I'm had not decided if I going to take a new device.
Sometime in June, I decided that I don't necessarily want that contract and when I called to cancel, I was told that I'm on a 24 months contract and to cancel it I need to pay about R2000. I don't understand what this is for since I didn't take any device. They allocate data and minutes to my number and make a debit order deduction from my account. What is this penalty for?
Anyway, I request the call recordings. On the recordings, I clearly stated, when the consultant read the terms, that i do not want a 24 months contract and that if that package is on a 24 months then he should make my number a prepaid. He agreed to put me on month to month. How I ended up in a 24 months, I don't know. I mean Commercial Law 101 requires that there must be a clear intention and consensus between the two parties, for a contract to be valid, but if you are untouchable like Cell c, this basics do not apply to you. You can just do as you wish.
I have been logging calls, and I keep getting the same reply, "the customer was advised that the contract is a 24 months contract". They don't say that the customer didn't agree to the 24 months contract, when the terms are read. It doesn't suit them, because I have clearly amended the terms as they were read. What's important to them is the debit orders each month.
I want my debit order refund and reimbur*****t for petrol and time for having to keep going to the store to listen to the recording that is clear.
I requested a copy of this calls since they are the basis for our contract, which I'm disputing, so I can get legal advice, but Cell c refused because it's their property. I can only listen to it in store.
Cell c is a ****. Do not take a contract with them, if you don't want to find yourself in my position. If you do take a contract with them, please be very very careful.
