Cell C committed Breach of Contract and ******ion, caused by Buffoonish Discourtesy

This review will be the second I write in a space of a week, bemoaning a corporate service provider, whom provided poor service [for which I will name a branch and an individual] and culminated with ******ion by a third-party, over a space of a 2-year period and is indicative of breach of contract and misconduct in consumer rights.

My Mother, PM NELL, approached Cell C [Menlyn Mall branch], originally on December 12th, 2022, in to apply for a phone contract, which at the time came with a tablet device as part of the promotion [I'd complained about this on a previous occasion, when the rep rather conveniently mentioned thereafter the tablet was no longer part of the promotion, yet the premium for the contract was still in effect]

We wanted both the cellphone and the tablet as promoted, yet when inquiring about this matter with Cell C Menlyn's Branch Manager, one Brandon Vorster, the snotty runt would reply to my Mother in an antagonist manner, a woman more than twice his senior: "Madam I suggest you read the fine print, while stocks last!"

Mr. Vorster, at the time you may have thunk yourself as quite a man, but as an only child, you can be lucky I didn't get my hands on you then.

Your behaviour at this time was unprofessional and disgusting!!

In the two years following, now I hold YOU and Cell C responsible for the fact that the premium of the contract had been handed to a third-party debt management firm, which is in direct violation of three specific laws, as indicated:

Section(s)90 and 121 of The National Credit Act 34 of 2005 - as the agreement had between my guardian, PM Nell and Cell C Menlyn, not through Nimble Credit Facility. This would've enacted a new agreement entirely between the latter party and my guardian, thus rendering the original phone contract null-and-void.

The Consumer Protection Act 68 of 2008, specifically:

- Through means of the Expiry and renewal of fixed-term agreements. - Consumer’s rights with respect to delivery of goods or supply of service

[The second bulletpoint, I especially point DIRECTLY to Mr. Vorster]

And then finally . . . How dare Nimble Credit demand my Mother's credentials on an open phone line, a clear violation of the PoPI Act and a setting for identity theft!

On all grounds, we will not be paying ONE CENT further as Cell C committed breach of contract, *******ly let a third-party buy a debt which for some reason escalates in interest every month!

That is ******** without our written consent and nullifies any contractual agreement previously!!!

This debt is to be written off, per our collective Consumer Rights.

In fact Nimble Credit, you can claim it from Mr. Brandon Vorster, seeing that he let this happenstance occur on his watch on December 12th, 2022!

Good Day.

Thank you for your prompt response.

Yet be advised, even after a telephone call from your rep at 10:38 - the conditions are as such.

Cell C sold the credit Nimble Credit Facility without PM Nell's written consent, now their is NO agreement that we are liable.

We want that credit written off. PERIOD.

Here is where I present you with the FINAL ultimatum.

This wil NOT be over a phone, but on paper, with a stamp of approval on a letterhead.

You will email a letter of acknowledgement that all outstanding debt to the value of R76,265.76, which had been *******LY allocated by means of Nimble Credit Group has been UNCONDITIONALLY AND UNEQUIVOCALLY PARDONED for the account of one, PM NELL and that no further penalties will be issued, on the basis of contraventions of:

- Section(s) 90 and 121 of National Credit Act 34 of 2005
- Consumer Protection Act 68 of 2008
- The Protection of Personal Information Act of 2013

This notice WILL be issued by close of business today [30 Aug 2024]

Otherwise I will hand the matter to ICASA come Monday Morning.

This is NON-NEGOTIABLE, SO HOP TO IT!!!
