Cell C broke the law (EUSSC)!

Today, the 15th of March 2019. My wife was in hospital and her data bundle was depleted, and Cell C stole her airtime. This is despite receiving notification from Cell C that Cell C would NOT do this without explicit opt-in as per the new laws coming into effect 1 March:

"The amended End User and Subscriber Services Charter (EUSSC) Regulations will come into effect on 1 March, which will prevent mobile operators from automatically charging out of bundle data rates for customers who do not opt in to the service."

I checked in the *147# menu and it showed that there was NO limit on how much airtime could be used for data. I tried to change it and I kept getting a WASP error. Again, in breach of the law Cell C!

I demand the return of my airtime or I will be lodging a complaint with ICASA.

This sms was sent tout all our customers “As per regulation, you can opt-in or out of out of bundle usage. Dial *147# to manage your spend. If no data limit is set your service will continue after your bundle depletes.”

Customers who

  • Opt-in continue usage when bundles deplete
  • Opt-out are blocked when bundles deplete
  • Don’t make a choice will continue usage

How did Cell C break the law?
