Broken phone given with new contract (6 month old contract)

hi. I took out a contract at cell c, zevenwaght mall in november of 2021. so the phone is now a total of 3 and a half months old. it is a Samsung Galaxy A32. Since i got the phone it has had problems on it. in December, meaning the phone was 1 month old, i had to take it in for a overheating problem and the speaker at the bottom of the phone would not work. i took the phone back to cell c Zevenwaght mall in Kuilsriver and got told that. "i can not have the phone repaired as i did not take the 2nd type of insurance they offered" i then got told there is nothing they can do for me. I left, but this being a real issue i returned to the store a total of 3 seperate times with no help from anyone at the store. The last time i went, i got sanatized at the door and told to wait at the one corner of the store for the people to all get helped before me, just so that the one employee came to tell me, about 2 to 3 hours later, when everyone was helped that they will not help me.

now 2 days ago the phone started restarting on its own non stop. i have requested for my contract to be sent to me and i have still not recieved anything from cell c.

I will not be paying for a phone that was broken from the start of the contract. this phone has been a factory fault since i got it and cell c in zevenwenwaght mall outright just refuses to help me with it. i am sure there is some sort of guarantee and/or warrenty on this phone as it is new. i want my phone replaced with a new one and i actually want some sort of compansation for the rudeness i have had to endure at your staff an zevenwaght mall. I was a client of Vodacom for 15+ years and recieved this type of service from them. this is the reason i came over to cell c and now this is how i get treated?

if i do not get a replacement for this phone and some sort of compansation for this i will be cancelling my debit order to cell c and be giving this on at the NCC (national consumer commision) to have this reviewed and be asking for compensation with them.

this is totally unacceptable from a company as big as cell c. how can you sell me a contract with a broken phone and then refuse to replace it withing the first 6 months of the opening of the contract. this will make your contract void and means i do not need to pay for it.

i expect a promp reply from you on this matter and i expect in the very least a new phone.

hi. This is a update on my phone that you asked me to give in at a different shop. i gave the phone in at Tyger Valley on the 22/03/2022. on the back of the job card it states the terms and conditions for the repair. on the paper it states that "12 Working days, excluding public holidays" be granted for the repair. the 12 days were done on 08/04/2022. i recieved a SMS on 07/04/2022 to make arrangements with the place where the phone was given in for repairs(Tyger Valley). i phoned in on 08/04/2022 to the shop (tyger valley) and got told that my phone is still in at repairs and that they can keep my phone for up to 4 months. i also got told that the terms on the back of the job card is none and void? this is completely unacceptable i am sure you would agree as this is the proof that was given to me?

i would like to get my phone back ASAP from these people who seem like they dont want to help me.
