Breach of Contract

Breach of Contract. I signed up for a Pinnacle Unlimited Contract with Cell C in April this year. It was a special they were running and the total cost of the contract per month was supposed to be R 999, as advertised. The product description even states "... Pinnacle Unlimited at R999 pm x 24". The past 2 months, I have been charged R 1 049.80 for this contract. Upon raising this issue with the Cell C call center, I was told this is the new price of this product and they have the right to change the cost of the product as and when they choose. This is in the contract I signed. I have since checked my contract and found the following: Clause 5.1.5: " The Charges may be changed from time to time by means of publishing an amended Tariff Plan and by informing you in writing of these changes. Cell C SP will notify you at least 20 Working Days before the Charges are changed and you will then have the option to cancel the Agreement in terms of the cancellation provisions." Unfortunately I did not read this agreement properly before I signed. However, no where in my records can I find ANY communication from Cell C informing me of a change to the charges on my contract. Furthermore I cannot find any Tariff Plan anywhere on the Cell C website.

Cell C are in Breach of their Contract obligations.

Clause 5.1.8 of the contract, as well as Clause 2.1 "Charges" and "Price List" are not in line with Treating Customers Fairly. The way these contacts are worded means Cell C can theoretically increase the monthly charges on any of their contracts by R 5 000 or R 20 000.

I look forward to a formal apology from Cell C as well as a refund of the extra charges and a guarantee of the original contract pricing which I agreed to for the full duration of my contract.
