Bad business practice from CELL-C and hollard

Desember 15 2020 I took out a cellphone contract at CELL-C southgate mall branch.ten days later on the 25 desember 2020 I got hijacked and my phone was ****** together with other belongings in the process...

That same day I opened a case at the Lenasia police station and I called CELL-C to report the incident,

From their I had headache after headache being sent from pillar to post back and forth from the Southgate branch to Lenasia police station correcting the one thing after the other. Finally I was assisted and they inform me that they have sent all the documents through to the insurance company. (Hollard insurance)and they informed ne that the insurance will contact me

After couple days without hearing anything I went back to the branch and they gave me a nr to contact hollard self... At hollard I again was sent from pillar to post.. until they finally concede that they are busy with my claim..

Since then every every second day I call them to enquire how far they are with the claim and every time they promised that they will vo tact me the next day . That went on for about 2months..

In February 2020 , me calling them after several pillar to post sending I was told that my claim is approved .. and they will aent me a sms with the access amount..

About another week or so later I call again and that day they sent me a access amount of R1100 and I contested it since it's a R7000 Huawei P40 light, how could the access be so high when the time i insured the device they promised that it will be around R350...

I then went back to the same Southgate branch and even they were surprised how the access amount could be so high.. and i inform then that I don't have that kind of money

I never heard from either of them for the next 4months and i assumed the issue was settled , I don't have a phone and the insurance probably reimbursed CELL-C ...

Today 15 Jun 2021 I found a debit order of R3000 was deducted from my account by CELL-C

I then went to enquire what it was for since I don't have a phone, never used their services for 6months now and they never deducted since the time i informed them I don't have the money for that huge access and and i assumed the contract was cancelled on that grounds. Of which they told me at the Southgate branch that my accound was in arrears that's why they deducted the money and they can't do anything about it .

I then called the insurance to enquire what is actually happening here, whereby they infirmed me that the branch should've made me aware that I could've been liable for only Half of that access fee since I took out some sort of a access bridge product .. and now it's to late to claim anymore ..

Now i sit with a CELL-C contract which I still have to pay for the next 2 years,but no phone or aim card to use their services which I'm paying for.

I then tried to dispute the debit order via my Capitec cellphone app to recover my money, but I shows that I can't dispute that debit order ...

I don't intent to leave this thing here and thays why I came to you for advise on my next cause of action .... I can't pay for a contract and service that are not being rendered to me. .. now who do I hold accountable... CELL-C or hollard... Cause the one blame the other . CELL-C says their books doesnt know I don't use their services and since Im still on contract with them i must just pay for the next 2 years..

The consultant at CELL-C (big fat dude,just sitting and chatting on his phone all the while I'm talking to him and when I ask him for advise on what do do and how to proceed with this thing, he just keep on telling me "I don't know what you should do" just pay the monthly installments since you have a active contract.their is nothing they can do for me.

Even when I asked him ,say I'm now prepared to pay that access fee, take another handset, where do I insure it cause I don't trust hollard any longer, he just told me that they only use hollard, their is no other insurance option.

He then just gave me the bra of CELL-C customer care and told me to deal with customer care, he can't do anything ..

I'm so frustrated with the service I received from both CELL-C and hollard..

Please advice me what yo do next please

I managed to get a replacement phone from the insurance(after paying over R1100 on access fee) but now I have endless challenges with the Sim card... I can't do a Sim swop because in addition to that R1100 I transfered + R2949.94 cell-C debited from my account on theb15th, I'm still in arrears of R2400.00.. I went to the store yet again and the sales lady (very professional and helpful, short colored lady) assist me to call the customer care to enquire why I still owe a R2400, whilst R2900 was deducted from my account..
(whilst I'm having a contract of R360 per month with cell-C)... After I showed her the statement which reflect the debited amount.

I was requested to email proof of that payment, and I did so(again) ... Which was actually a very frustrating and worrying process because on their system it was supposed to reflect the deduction, because at the Southgate branch it reflects on their system, but conveniently it doesn't reflect on the system of customer care ...

After a very very long conversation with the consultant on the other end of the line, trying to get how a R365 cellphone contract accumulated to almost R5000 in 4 months, which amount to over R1000per month ( cause January installment they have received and then they took June 15 the R2900 which make the outstanding of February, March, April and May) , and she told me that it's accumulated interest on the outstanding amounts(which doesn't make sense cause I'm always having enough money in my account) but I accept her response, but she couldn't answer me when I asked... "COULD A R365 CONTRACT ACCUMULATE INTEREST 4TIMES THAT IN ONE MONTH"... she finally, at the end of the call say that maybe it will still reflect on their system.it doesn't reflect on her system. (even after the debit order payment of R2900 was made over a week ago)

And mind you if I can't make the Sim swop I'm still obligated to pay the services for data, minutes and and and which I don't get as of yet... Meaning I'm paying for services that are not being supp**** to me.

I asked her since they deducted that R2900, will I then receive all my data and things (which I paid for) and her answer to me was, they can't give me that data, they only roll over one month... So I forfeit the rest of the data,minutes and and and

I consulted with my legal wise legal advisor, and considering legal action for the suffering and lack of basic services, which by law im legally entitled to ... I'm now just waiting to see how cellc is going to address this issue ....

I for one, will never, ever ever refer anyone to cellc, matter of fact, I will make this my mission to expose these poor practice on every single social media platform I have access to, including colleagues in the media fraternity, if this matter are not handled on a fair and just way ...

I don't understand how businesses can be so openly *********,

I went to the cell-c Southgate branch to claim my contract simcard,the consultant (big boned African man) told me I must buy a new sim card and I can do a sim swop at home because it's free that way(after I explained to him the whole story, from the bigining). I went home try to do the simswop but was informed by the consultant on the line, because it's a contract sim, I have to do it in a branch, I explained to her that I came from the branch but the big consultant told me that if I do the simswop in the branch I will have to pay R170 cash right their before they even start, but it's free if I do it over the phone myself..

Since I do have simcard insurance aside from the device insurance, she said I must just go to the branch and tell them that.. They have to give me a new sim, cause that's the reason insurance is their for...

I then went back and told the consultant what I was told over the phone.. But he insisted that I must pay the money, and then just claim it back from the insurance..

My issue is... Why do I pay sim insurance if I still have to be charge for a simcard... What is the sim insurance installments their.??

For 2 years now I'm paying for service I technically don't get.. because I'm paying for a data package(phone plus data)... I received the phone after 6 months but not the simcard(mind you all these time I was paying for all this) .. So I still have to buy my own data with a additional sim that's in my phone... no one can help me in that branch and when I make phone calls, I'm being sent from pillar to post .. and still at the end of it all, the calls get dropped and I have to start the process all over again... I'm so disappointed and frustrated in cell-c for such poor ********* service..

If their is someone out their, a consumer lawyer or someone, please assist,I will pay your fees,.. Because I am not the only one complaining about this very same issue.. And sooner or later we have to stand up against these giants who think they can just do as they please...

I will never have dealings with cell-c or hollard ever again, and I will make sure this letter goes to all social media platforms, family and friends to warn them against these type of treatment..
