7 day return policy not in line with customer protection act.

7 days return policy

On 3/11/16 I UPGRADED MY 24month contract. I received the Apple i phone 5s on the pinnicle contract advertised at R299/m cell phone. The Cell C employee said I had 7 days in which to return the phone if faulty and that it would be exchanged with a new handset. On Monday 7/11/16 I wanted to return the phone as it seem to be faulty. if you face time the person on the other side can only see you and not hear you. and when someone phone you, you can barley hear, you have to switch to speaker to hear anything The Cell C store assistant examined the phone and phoned my number from her phone and confirmed that she can also not hear anything. Instead of issuing me with a new phone, I was told the phone must be returned to the supplier to check for faults. And that the phone will only be exchanged if faulty. This contradicted the earlier explanation of the returns policy. When I asked to speak to the manager, she said she doesnt know why the sales assistant said that they will exchange the phone if it is returned with in 7 days, she will return shortly, then i can ask her... I now had to give the phone in for assesment - and was given a "Loan blackberry" that wasnt even charged to use for calls and sms's - which is not why i need my ceel phone as i use it purly for data. this is reduculous that the people in the shops say one thing but mean another.

yes Palesa phoned me but could not help in sorting out the fact that i received a faulty phone and that the store doesnt want to replace it even though i returned it with in 4 days. so the store booked the phone in to be send to Johannesburg service centre to be assesed. it is now a week since i took the phone back - and still no answer.....i phoned the store - cell c grand parade, and they said that tehy send the phone with RAM to JHB, it should be there. i got told that i must phone the service centre in JHB to find out how far they are. so I phoned 084140 and asked to be put thru to the service centre. I gave them my ref number: WPCAP68298 and the consultant told me that they have not received the phone yet, that the case is still closed because the store didnt book in the phone in the correct manner. so in the meantime i am paying for a phone and a service that i do not have and no one can tell me where is the faulty phone. I am realy not very happy with the service, especially as I have been i client for the past 10 years already with Cell C. I am not happy that i get told taht if i return the phone if faulty with in 7 days that it will be replaced, and now i have to wait fo who knows how long to get a new/ fixed phone, I have to leave for overseas shortly and dont have a phone!!!! If Cell C cusatomer service doesnt sort this out by the end of the week, i will be forced to cancel my cell c contract and go toanother service provider.
