Good day,
I have signed up for a Contract with you guys and as per telephonic conversation I asked for this to be debited on the 25th of Each month as with my other two contracts as well. When dealing with the agent she advised that I Will be charged prorated from the date of the delivery.
My device was delivered 30/07/2024 and on the 01/08/2024 cell c tried to debit my account. I asked for my account to be debited every month the 25th
There are two things in question here. Who authorized you to debit my account on a date I did not agree to neither gave consent to Debit. Is it nog against the law to be putting through unauthorized debit orders
I Called your customer support last week on the 1st, I asked to Speak to a manager which I was transferred to and He advised that they will investigate and they will go to the recording to see what was agreed upon and should they find that nowhere in the conversation was anything disclosed about being debited on the 30th, neither was anything mentioned that Cell c has a new system now where they debit the first debit order on the first of the month for any new contracts. Looking at the subscriber user agreement sent as well no where is such a clause stated that there's a new systems where the debit goes off on the first of the new month for all new contracts, I saw a Clause that said the ONLY TIME cell c can debit order earlier is when I'm in arrears. Since the device was not even 3 days with me how do you justify me being in arrears for it already?
Your manager promised that the turn around time is 48 hours, today is the 8th 7 days later no one called back I am the one to call back and when I get through to customer care I am told again I must reach out to collections. So after making promises about your turn around time the owners is now on me to run after you.
I asked the manager what debit order date he sees for the new contract line he confirmed its 30th, I Asked again who authorized cell c to put that date there and he could not answer. I did however ask for that to be updated again to 25th and he said he did.
So since I used the device the 30th and 31st only Cell c has concluded that the prorated amount is 699 for the two days of usage?
The burning Question I have is who authorized cell c to select a date that they want without my consent for debiting this contract? You are in breach PASA regulations its like debit order ***** i will log a formal complaint for this to be looked into with the Debit order tribunal.
Case Number: ***
