DEPOSIT ****** BY CBD RESIDENCE
Hi, my name is Khololwethu Buso I am a student at Tshwane University of Technology. I began my stay at CBD CELIERS RESIDENCY in Sunnyside Pretoria in May 2021. I signed a lease From May to November 30th for a room costing R3200. Having stayed and studied up until November. On November 5th the caretaker had come to my room asking me to sign a notice of when I am moving out and at that time the Timetable of my exams hadn't been released yet so I signed to the end of the year which is December 31st. On the notice paperwork it clearly stated that i can changed my mind on when i move out up until the 20th of November. The Timetable for my exams was released a week after i had signed the notice agreement on the 5th of November, so i went on to cancel my notice as it stated i could cancel (bear in mind this was a courtesy extension since my original contract ends 31 November) before the 20th of November and they refused to let me change the date of the notice telling me that they had already submitted the paperwork. That having happened i was forced to pay full rental for the month of December having already written my exams and finished and vacated the room, i didn't have the funds to pay my rent of December and they didn't allow me to leave with all my clothes for the festive season, so with the little i had left i paid R1500 of the R3200 needed for the month and left with only one bag of clothes that they allowed me to take and left the rest of my clothes and valuable belongings in my room. the 12th of December i receive a call from the caretaker with her saying all my belongings left in my room would be put in the storage room( because they were closing for the year) if the remaining R1700 of R3200 wasn't paid. Hearing that news and fearing my belongings going missing in the storage i borrowed the R1700 and paid the remaining R1700 on the 31st of December. After paying the rent for December, i continued to call the manager to find out when i can get my belongings from the storage they said they had put them in, i couldn't reach her, but on the 2nd Of January i got hold of her through the main offices and she informed me of the problems the building had had with electricity so she couldn't get in contact with meor access her email to confirm my payment but said i should come on the 7th of January to collect my belongings from the storage. When i get there to get my belongings i find out that my belongings were in the room packed in bags the whole time throughout December and that she had **** about them being in a storage department, on the 7th of January the date she said i can come and collect my belongings from the ''storage'' she then states that because of my belongings being in my room for the month of January i need to pay the R3200 rent again of the month just to move out. Mind she **** and said my belongings were in the storage so i had technically moved out of the premises and any fee i should even think of paying was the days my belongings were supposed to be in the storage meaning 1st to 2nd January. she refuses to answer why she hadn't informed me why my belongings were still in my room not moved to the storage as previously communicated as i am no longer taking up a room. At this point i have no more money to pay them as i scrambled to pay the full rent of December when i didn't even stay there and now i am being forced to pay the rent of January as well and i was informed that my belongings weren't occupying the room anymore. She (the manager) knowing that i cant' pay for rent for this month says i forfeit my deposit of R3200 that i paid back in May when i started my stay, to pay the rent of January because my belongings were still occupying a room when she had clearly said that they were in storage so i have left with nothing and that company and her have taken my deposit to pay for January a second month of rent that equals R6400 gone to CBD RESIDENCES because they didn't allow me to change my notice back in November for the month of December forcing me to pay R3200 when i didn't even stay and again in January the manager having **** about my belongings going into storage they took my deposit of R3200 to pay themselves as I couldn't have possibly paid again for a second month of me not staying there.
THEY HAVE ****** A TOTAL OF R6400 FROM ME AND I AM SEEKING ASSISTANCE ON HOW TO GET MY MONEY BACK
( I ) am writing this to ask for any method i can take to get my deposit as i have payed out my lease and now they are refusing to refund my deposit.
