Unjust Account Freeze Without Prior Notice or Clear Communication

Unjust Account Freeze Without Prior Notice or Clear Communication

Dear Capitec Bank Management,

I am writing to express my extreme outrage and profound dissatisfaction with Capitec Bank’s utterly deplorable handling of my case. Your decision to freeze my account without any prior warning or clear communication is nothing short of disgraceful and completely unacceptable. This reckless action has left me unable to access my own funds, causing significant disruption and distress, and I demand immediate accountability and resolution.

Capitec’s failure to provide any advance notice of this freeze is a gross violation of basic customer service principles. Furthermore, your bank neglected to send me a comprehensive list of required documents to resolve this issue, leaving me in the dark and unable to comply efficiently. The only mention of requirements was a vague reference to an ID on the app, which is wholly inadequate and reflects a shocking lack of transparency. This is not how a reputable financial institution should treat its clients—it is an egregious breach of trust and professionalism.

I have attached all documents I believe are necessary to lift the freeze on my account, despite your failure to clearly outline these requirements. I demand that you process these documents immediately and restore full access to my account without further delay. Additionally, I expect a formal explanation for this unjust action, including why no prior warning was issued and why clear instructions were not provided.

Be advised that I have escalated my dissatisfaction to all relevant parties, including regulatory authorities, and I will not hesitate to pursue further action if this matter is not resolved promptly. Capitec’s cavalier approach to handling my account is intolerable, and I insist on an urgent response detailing the steps you will take to rectify this situation and prevent such failures in the future.

Yours sincerely, Mr. P. Stofile

Ongoing Mishandling of Account Freeze by Capitec Bank – Case No. ***1 CM

Dear Capitec Bank Management and Hello Peter Community,

I am compelled to write this letter to express my profound dissatisfaction and outrage at the ongoing mishandling of my account by Capitec Bank. As Mr. P. Stofile, with case number ***1 CM, I have endured an ordeal that is arbitrary, unjust, and deeply distressing.

My account was frozen without any prior warning or clear communication, forcing me to visit a Capitec branch to investigate. There, I was told only that a certified copy of my ID was required—information vaguely mentioned on the app but never explained. I submitted a sworn affidavit, proof of address, and certified ID in good faith. Only after I lodged a complaint via Hello Peter did Capitec temporarily lift the freeze. Today, July 24, 2025, I received their response, which for the first time cites section 2.15 of the savings account agreement as justification, claiming the right to freeze my account without notice due to suspected *****ulent, *******, or non-compliant activity. This belated reference, introduced only now, exposes their initial lack of transparency and accountability.

To add insult to injury, Capitec has now demanded a new list of documents— including invoices and receipts for business expenses, business registration documents, and a lease agreement (if applicable)—despite my earlier compliance. The Complaints Management team, represented by Consultant Ni-Shaat Lamb, has closed my complaint, stating no further action is required. This dismissal is outrageous, as the issue remains unresolved, leaving me uncertain about future freezes.

As a pastor, I generate income by training church leaders in discipleship for Smallcircle Inc, a U.S.-based religious organization. These funds, received via Capitec’s Forex division under a standing instruction (account number ***, renewed regularly), include donations, travel allowances, and appreciation stipends—not a salary. I have no formal contract, payslip, or office, operating from my home. This legitimate ministry work, which I refer to as self-employment and consultancy, is the likely reason for Capitec’s suspicion. I provided a standing instruction and indemnity (attached) to facilitate these international transactions, yet Capitec failed to communicate any concerns until forced by my complaint.

Capitec’s behavior is unacceptable. Their failure to provide clear reasons for the freeze from the start, their moving of goalposts with new document demands, and their dismissive attitude are insulting and potentially damaging to my ministry. The bank’s retroactive reliance on section 2.15—never mentioned during the initial freeze or branch visit—suggests a lack of due diligence. As a religious worker, I should not be penalized for receiving legitimate international support without proper notice or explanation.

I demand, in the strongest possible terms, a detailed and specific explanation of the exact transactions or activities that led to the suspicion of *****ulent or ******* behavior, including why this was not communicated initially. I insist that Capitec provide a definitive and complete list of all required documents, considering my unique situation as a pastor with no formal business structure, and ensure my account is not subjected to arbitrary freezes again. This ongoing ordeal must end.

I have escalated this matter to regulatory authorities, including the Ombudsman for Banking Services (OBS), and will pursue all available avenues to seek justice. I am sharing this letter publicly on Hello Peter to highlight the injustices I have faced and warn other consumers, especially those in ministry or self-employment, about Capitec’s questionable practices. I urge Capitec Bank to act with integrity and urgency to rectify this situation. Failure to do so will leave me with no choice but to pursue further legal and regulatory actions and continue raising awareness through public platforms.

For reference, I have attached copies of all correspondence and documents submitted to date, including:
- My original complaint letter.
- Capitec’s response dated July 24, 2025 (17:42–17:43).
- The savings account agreement (P.Stofile - savings agreement.pdf).
- The standing instruction and indemnity (Standing Instruction Capitec Forex.pdf).
- Proof of documents already submitted (sworn affidavit, proof of address, certified ID).

I expect a prompt and substantive response from Capitec Bank, addressing each of my concerns and providing a clear path to resolution by no later than 11:13 PM on Saturday, July 26, 2025. Anything less will be a further demonstration of Capitec’s disregard for its customers.

Sincerely,
Mr. P. Stofile
