Release my funds Capitec Bank!
To: Complaints Management Officer, Capitec Bank Attention: Nompumelelo Masuku Re: Formal Objection to Case Closure – Case Number: ***9 I am writing to formally reject the "Confirmation of complaint closure" regarding the aforementioned case number, as detailed in Screenshot_***_Email.jpg. The current resolution is entirely unacceptable and legally tenuous. As explicitly stated in your correspondence, only "certain funds" within the account are under review. Despite this, I remain unable to access the substantial balance that is not subject to your investigation. This blanket restriction is a gross overreach of the bank's authority. Furthermore, a comprehensive proof of payment was provided nearly a week ago, yet there has been zero movement toward reconciling these accounts. Crucially, the account was restricted and subsequently closed without any prior warning or notification, a practice that deviates from standard transparency and fair banking protocols. I have maintained daily contact with your institution, providing every opportunity for a swift and reasonable resolution. Your continued delays and the unilateral closure of this complaint—without the release of unrestricted funds—demonstrates a negligent disregard for the following: Financial Solvency: The freezing of accessible capital has directly impeded my ability to manage business operations. Daily Living & Family Welfare: These funds are essential for the maintenance of my household and the support of my children. Procedural Failure: Closing a complaint while active funds remain withheld constitutes a failure to provide adequate banking services and violates standard consumer protection principles. Be advised that I do not accept the closure of this matter while I am being deprived of my legitimate assets. I demand the immediate release of all funds not specifically flagged under the active investigation. Failure to rectify this immediately will result in an urgent escalation to the National Financial Ombud Scheme and the pursuit of all available legal remedies to recover damages caused by this disruption. Govern yourself accordingly.
Your acknowledgment of receipt is noted, but let me be exceptionally clear: the "next business day" is a luxury of time my client does not have. We find this standard bureaucratic stalling to be entirely insufficient given the gravity of the matter.
Furthermore, we are fully aware that the Ombudsman’s standard fifteen-day window for case review exists, but in this specific instance, such a delay is professionally and ethically unacceptable. My client requires an immediate resolution, not a placeholder in a queue.
It is patently obvious from your dismissive posture that the well-being of your clients is not a priority for your institution. This lack of care is vividly reflected in your public standing; a 1.3 out of 5-star rating is a damning indictment of your service standards and speaks volumes about how you treat those who entrust you with their livelihoods.
We do not require "designated officials" to make contact at their leisure. We require this matter sorted now. Consider this the final opportunity to rectify this situation before we escalate matters further.
Regards
