Non existant service but they want money

Firstly I would like to start off the fact that I am very unhappy regarding how this matter has been handled.

The Sheriff of the court went to an old address and threw the papers at the new people living there when they refused to accept it as he was told we no longer live there. My wife was walking with our daughter when she overheard a conversation where people were discussing me and stopped to ask what they were talking about, She then took the judgement papers from these people.

She enquired if they have ever received any accounts on our name in the post to which they rep**** that they did not.

So no accounts were sent but you want to take judgement against me. And in a very rude manner and giving out my personal information such as work details, ID number, bank account number etc to strangers.

The papers are dated and stamped in April but was only delivered 13 August. So my right to defend myself has been taken from me as 10 days has long passed.

1. Capitec bank never asked me for my expenses per month when doing the loan in the first place.

My salary dropped after season to just my basic which is about R9400 – R9600 per month. So firstly I could never afford a loan. If they asked for my expenses instead of lying to get the biggest possible offer they would have known that.

2. Money was paid into my capitec account – a loan I took from work to buy food. R3000. Capitec bank took this money (sett off) without my permission. I did contact them to reverse it and they refused. as per your records you will see that I stopped paying you app**** set-off on my account and stole my childrens food money from my account.

3. I am however willing to make an arrangement with you if you stop the judgement you are applying for. Also note that I am not going to pay money in at lawyers or deal with them as I know they take about 2 thirds for themselves every month you pay. I want the account to be closed and all interest stopped so I will be able to repay this loan and finish it before I die of old age.

I can offer R500 per month. When we work overtime or earn extra I can pay more but my affordable option at this stage is R500. I cannot over indebt myself any longer.
