De*****ed on the Capitec APP - but the bank refuses to refund! Appalling!

Case *** On tuesday morning 25th of February at around 09H30 , I received a call from someone claiming he was from vodacom. He said to me someone is trying to open a phone contract using my number, he then told me to switch off my phone and also said my network will also cut. I got so suspicious then I stopped my Capitec card using my Capitec App.this was after 10H00 the same day. Immediately after that my phone network was gone the whole day of tuesday 25th feb . The next morning I went to Capitec bank in Rustenburg to re-open my card , thats when the lady at the bank told me my money was gone/****** .She then suspended my App and cellphone banking. She called their investigation department and gave them my problem .I went to vodacom retailer to fix my network problem , then they told me my phone number was hacked and destroyed. I bought a new starter pack and I went back to the bank to give them my new phone number so that they can contact me during their investigations. I then went to the police station to open ***** case On Thursday 5th of mach Capitec contacted me saying they are unable to refund me, because they claim it was by my own negligence. My argument is I am an ordinary man in the street who has no power to fight against **********, and I entrusted my money with the bank. They provided me with an APP which I used when I was suspicious but it did not work. The ******* were not supposed to be able take the money if the APP worked properly. The bank was supposed to detect irregular transactions and suspended my account immediately and not just wait for me to bring it to their attention. Like other major banks their system should be able to pick up such irregular and suspicious transactions. Please we need the money back as this is a serious setback.

Response not satisfactory and is shifting blame on client for ineffective bank APP, and slowness of the bank to prevent ********** transactions from happening.

below is my detailed response:
  • Firstly I did not indulge any of my personal information either via SMS or phone call, my personal information was leaked somewhere else, but definitely not by myself
  • I stopped the card via the APP as I suspected foul play once I was asked to switch off the phone by the callers.
  • The bank APP asked the reason to close the card and I chose ***** threat, and it confirmed the card was stopped and I needed to contact the bank for further transactions.
  • Why then did it allow the transactions on the card/bank account to take place after it was stopped? If I couldn’t transact myself and had to reactivate at the bank. This does not add up, surely the ********** transaction should not have been allowed to transact as well.
  • If it was indicated in the APP that there are ********** transactions, is the bank not using this as another form of communication with clients? If not then what is the use of it?
  • Going physically to the bank cannot be the only way to report suspected ********** transactions. I used the provided APP to inform the bank before all this.
  • Your APP is flawed and I cannot take the fall for it.
