DECEASED ESTATES & MARRIAGES IN COMMUNITY OF PROP

We administer deceased estates and are experiencing problems with Capitec to get bank accounts closed in the name of the deceased. The documents we recently submitted were for an estate where the couple were married in community of property. <br> <br> Even though we don't agree because the Letters of Executorship have both their names listed, we still understood Capitec's request for the marriage certificate to provide us with details for the surviving spouse. We had submitted a copy which was not clear enough. They wanted a clearer copy which we informed them we will only be able to provide them with in a month's time when the spouse brings in the original for us to try and make a clearer copy. The couple were married in 1966.<br> <br> However Capitec also wants the marriage certificate before they will close the deceased's bank accounts. Accordingly to their staff, both names are on the Letters of Executorship and this is an internal requirement. I would have thought that FICA documents for both spouses which they have would be sufficient.<br> <br> So if you are married and want to have your Capitec account closed, you have t get your spouse' permission first.<br>
