CAPITEC THE BANK FOR INCOMPETENCE

I am formally lodging a complaint against Capitec Bank for what appears to be non-compliance with a valid court order and extremely poor handling of my matter.

On or about 14 April 2026, a court order was granted in my favour. Despite this, Capitec Bank has failed to comply with the order.

On 16 April 2026 at approximately 09:10, I received a telephone call from Capitec’s ***** Department. During this call, I was informed by an agent named Funeao that Capitec’s internal policies take precedence over a court order and that the bank would therefore not comply with the court order.

This statement is deeply concerning and unacceptable. A financial institution operating in South Africa is legally bound to comply with court orders. Internal policies cannot override judicial authority.

I have also recorded this telephone conversation as proof of what was communicated to me.

As a result of Capitec’s conduct, I am suffering ongoing prejudice and financial disruption. The refusal to comply with a court order undermines trust in the banking system and raises serious concerns regarding compliance and governance within Capitec Bank.

Requested Resolution:

Immediate compliance with the court order dated 14 April 2026 Written explanation of why Capitec believes internal policy overrides a court order Written confirmation of corrective steps taken against improper guidance given by staff Escalation of this matter to Capitec’s legal and compliance department

If this matter is not resolved urgently, I will escalate the complaint to the Banking Ombudsman, the South African Reserve Bank, and consider further legal enforcement steps.
