Capitec is Committing ******ion

Good day to Whom this may concern.

The Following I am about to transcribe is a chronological history of how Capitec Bank had knowingly ******ed monies beyond a consumer's median salary and as a customer my consumer rights have been violated and their call centre staff have acted untoward and atrociously.

In the second quarter of 2022, my mother - PM Nell app**** for a revolving credit scheme: Every month a balance would be allocated to lend unto my mother and the amount lended during the month would be subtracted via debit order.

We app**** for this revolving credit scheme at Capitec Bank Parkview Mall [Pretoria East] and for awhile, we did well with this agreement. I'd been unemployed at the time and we desperately needed the finances. Between the latter mentioned period between August 2022 until April 2023 we upheld to this agreement.

A no-reply notice sent Friday, April the 7th, 2023 sent by Capitec via email informed my mother that the Revolving Credit Scheme had been, without her consent, overturned into a standard bank loan and as such would be charged additional interest rates!

Nowhere did Capitec have the consent, nor the power to do so! Without proper procedure nor through our written consent!

This contravened the Consumer Protection Act 68 of 2008:

- Through means of the Expiry and renewal of fixed-term agreements. - Consumer’s rights with respect to delivery of goods or supply of service

This equally contravened the PoPI Act.

Since this time that Capitec not only ********ly decreased the access facility limit, in terms of the previous agreement; close to every 25th of each month, my mother is taunted through call centre agents who demand her ID number on an open phone line, yet they have her credentials.

Capitec also contravened Section 90 and Section 121 of the National Credit Act, 2005 - they had no right to enact a consumer's debt unless we gave them written permission!

As such this is ******ion by Capitec!!!

I demand this debt be written off this instance!

Here is where I present you with the FINAL ultimatum.

This wil NOT be over a phone, but on paper, with a stamp of approval on a letterhead.

You will email a letter of acknowledgement that all outstanding debt to the value of R73 409, which had been *******LY allocated by means of Nimble Credit Group has been UNCONDITIONALLY AND UNEQUIVOCALLY PARDONED for the account of one, PM NELL and that no further penalties will be issued, on the basis of contraventions of:

- Section(s) 90 and 121 of National Credit Act 34 of 2005
- Consumer Protection Act 68 of 2008
- The Protection of Personal Information Act of 2013

This notice WILL be issued by close of business today [30 Aug 2024]

Otherwise I will hand the matter to ICASA come Monday Morning.
