Capitec card division protects shady merchant over SA consumer law

When an online merchant contravened the South African Consumer Protection Act (CPA) by using bait and switch price tactics and adding a surcharge for using a mastercard debit card and refusing to refund the difference, I contacted capitec to try and resolve the matter.

Despite informing the agent that the merchant was breaking the rules laid out in the CPA, Capitec's card division completely failed to protect me as a consumer. I provided an airtight, step-by-step screenshot evidence pack of the entire booking flow proving the price discrepancy, the agent prematurely closed my case, citing the merchant’s internal terms of service, completely ignoring the fact that no company's policies can legally override South African statutory law.

To make matters worse, the agent factually misinformed me by claiming Capitec has "no dispute rights as per Mastercard Rules." Mastercard explicitly prohibits deceptive checkout architectures and non-compliant debit card surcharging. Capitec has full rights to lodge a compliance dispute, but they chose the easy way out.

When I refused to accept this poor level of service and requested an internal escalation to a supervisor, the agent passed me off to the complaints department and provided a non-existent, bouncing email address (***).

This lazy "tick-the-box" attitude and total disregard for the CPA is unacceptable. I want this matter looked at by a senior dispute specialist that is fami**** with South African consumer law.

If Capitec is unwilling to uphold consumer law for its account holders, I intend to bypass them entirely and take this matter straight to the National Consumer Commission (NCC) and the National Financial Ombud Scheme.
