Breach of contract & *****
My wife has bwwn with capitec for number of years & as of recent we have discovered how ********* & darn right disgusting this bank is. My wife took out a loan with capitec & in the contract they noted that her salary date is the 30th of every month (with proof of a payslip) & the contract was signed for the debit order to go off on the last day... every month, since the start, without fail, capitec have tried to debit her account on the 23rd, telephonically harassed her & sent sms to say she has failed to make payment & thus have added interest / late payment fees & bounced fees to this loan account. Despite our nemerous emails, phone calls & attempts to get this sorted, Capitec just doesn't give a FK & in the last phone call, WE were told WE need to prove her salary is only paid the last day. 1. this is absolute BS! since when can a debit order be run on the 23rd if salaries are normally paid on the 25th?? 2. how is capitec even allowed to run a debit order outside of the agreed contractual date?? 3. how is capitec allowed to penalise my wife for them operating outside of the agreed contract? 4. why do WE have to prove anything, when all of the forms & proof were already submitted with the original contract? This is blatant BS & should be ******* as Capitec are in breach of the contract & making ******* charges to my wifes loan account... Not only that but when we need to take the covid-19 payment holiday, they didnt just add 3 months extra payments, but they also increased the interest rate regardless of the repo rate being lowered??? This is pure *********, thievery!!! We are in the process of contacting the NCR, making a complaint & reporting this bank for ***** & breach of contract!
