Unwilling to assist

Good day,,

I approached this Campbell attorneys based on their reviews.

I confirmed if they offered the service I was seeking. They did. I emailed requesting further information.

The first email response I received was in response to debt review withdrawal and did not provide information to the second question in my query. Because of this I called to ask for this information. I was told to respond to the email. I sent a follow up email and another because I didn’t get a response for a week.

Good day,

We cannot assist. The debt counsellor must bring the reckless credit application to court.

However, this is what their website states.

Q: What information do you require to assess whether my credit agreement constitutes reckless credit?

A: The information we require to determination whether there is a case to be made out for reckless credit includes the following:

The date the credit agreement was concluded A copy of the credit agreement A copy of the pre-agreement statement and quotation • Details concerning your financial means, prospects and obligations as they existed at the time the credit was granted Information concerning the credit assessment that was conducted by the credit provider Section 170 of the National Credit Act read with Regulation 56 obliges a credit provider to keep records of all applications for credit, credit agreements and credit accounts for a period of 3 years from the date of termination of the credit agreement.

I was asking for help with the application. The website does not state “what information does the debt counselor require to assess whether the application for reckless credit”.

We cannot assist. The debt counsellor must bring the reckless credit application to court as you are under debt review and as per section 87 of the NCA, the debt counsellor must approach the court for an order of reckless credit determination if applicable. You have also paid fees to the debt counsellor hence it is not necessary to pay us to assist when the debt counsellor ought to act on your behalf and has received a fee. Should the debt counsellor not fulfill any duty, then this can be referred to the NCR.
