********* Harassment & Practice

I have been paying off my FNB overdraft for a year based on an agreed arrangement, in November it was handed over to Brooks & Luyt. Subsequently we have received a summons for an attempt to get a summary judgement against me. Despite repeated attempts by my lawyers to avoid a court date, even with an offer to increase payment, B & L refuse to budge.

They never communicate in writing, you have to deal with *********** call centre staff who know nothing about your case. Last week I was randomly told of an amount that I am now expected to pay, when I asked why they had never told me this before, their response was, I never asked.

They phone between 3-4 times almost EVERY DAY (including Saturdays). They REFUSE to acknowledge my prior agreement with FNB, and now they are deducting all their fees related to the summons from my account - meaning, since my last payment to them I know actually owe MORE than I did before.

I am doing my very best to pay every month, how can reputable attorneys attempt to get a summary judgement against you when you are making every good faith effort to pay,

I believe B & L act in a highly *********, and borderline ******* way. They are the ONLY ones that benefit from potential litigation, the money I would spend to pay my debt now goes to them.

We are doing every thing possible to resolve this, I ma incurring legal expenses completely unnecessarily. If they would simply communicate effectively we could avoid court - but clearly this is not in their interest as if we go to court they are the ONLY ones who get any money.

FNB should know how *********ly this firm operates. I will be going to the banking Ombudsman in this regard,

We further confirm that the matter has been escalated to the manager overseeing the respective portfolio for investigation.
