1 Star – Extremely poor treatment and completely unacceptable communication

My experience with Brooks & Luyt Attorneys, and specifically their consultant Leverge Hendricks, has been extremely disappointing. I understand that debt collection is part of the process and I have no issue being contacted regarding an ***. What I do have an issue with is being spoken to in a condescending, rude and disrespectful manner. Mr Hendricks has a way of speaking to people that comes across as though he is personally offended by the fact that they have a debt. The tone is belittling and judgmental, rather than professional. Nobody should be made to feel as though they are somehow less deserving of basic respect simply because they are dealing with financial difficulties. And this isn't a once-off. On 2 September, I specifically told Mr Hendricks that I did not want to deal with him again and that I would be happy to communicate with another consultant. Despite that, I was contacted by him again on 29 September. During the latest call, I explained that I am under debt review. I then found myself having to explain how long I have been under debt review — as though that somehow determines whether I deserve to be spoken to respectfully. For clarity, debt review is a formal process under the National Credit Act for consumers who are over-indebted. It exists to help consumers manage their credit obligations through a structured process, including the possibility of having their debts rearranged. It is not a licence for debt collectors to treat people as though they have forfeited their dignity simply because they are struggling financially. In fact, I would expect a company involved in debt collection to understand this better than most. People who are under debt review are already dealing with financial pressure. The purpose of professional debt collection should be to communicate clearly, deal with consumers respectfully and work within the appropriate processes — not to talk down to them or make them feel humiliated. My request to Brooks & Luyt is very simple: Please audit the calls involving Mr Hendricks, particularly the calls on 2 September and 29 September. Listen to the tone and manner in which he speaks to people. Then ask yourselves whether that is genuinely the standard of communication you want representing your firm. Mr Hendricks needs extensive training in professional communication, customer service, dealing with consumers under financial distress, and frankly, basic respect when speaking to another human being. Being a debt collector does not give anyone the right to speak to people as though they are beneath them. Being under debt review does not make someone a lesser person. And having a debt does not mean you have to accept being spoken down to, belittled or treated without basic courtesy. I would strongly encourage Brooks & Luyt to take this complaint seriously and review the conduct of the consultants representing their firm. The way you communicate with people matters — particularly when those people are already in a financially vulnerable position.

Blatant disregard

So, despite submitting a review on how they harass me for money owed by someone else and subsequently receiving their standard response "We apologise for the inconvenience, blah blah blah, the harassment continues. SMSs continue for Mr Minisi who owes R201 to MoreTyme. These people are not taking this platform seriously.

Absolutely Appalling Treatment by Brooks & Luyt Attorneys

If this is the standard of service that Nedbank considers acceptable from the attorneys it appoints to deal with its clients, then both companies have a serious problem. My Nedbank credit-card account was handed over to Brooks & Luyt Attorneys after Nedbank agreed to accept a debt-review arrangement. I am currently under debt review, and my other creditors have accepted the arrangement and are receiving the agreed monthly payments. Brooks & Luyt, however, appear to have little interest in the facts, the circumstances, or even basic professional courtesy. For approximately six months, I have been subjected to repeated telephone calls from this firm. I have made one very simple and entirely reasonable request: please communicate with me by email so that there is a written record of what is being requested and what has been communicated. This request has repeatedly been ignored. The telephone harassment is another matter altogether. I can receive four or five calls in a single day, and on some occasions the person calling does not even speak when I answer. Of those multiple calls, perhaps two result in an actual conversation. When I do manage to speak to someone, the experience is frequently appalling. Calls are cut off while I am trying to explain the situation. Operators argue with me without apparently having established the facts. I am not given a reasonable opportunity to explain the circumstances, and when someone does, on the rare occasion, actually listen, the specific requests I make are simply ignored. Which, of course, results in another call. And another. And another. This is not what I would expect from a professional legal practice. It is certainly not what I would expect from a firm acting on behalf of one of South Africa’s major banks. Brooks & Luyt need to understand that the person on the other end of the telephone is a client of their client. I am entitled to be treated with basic professionalism, courtesy and respect. Debt review is a regulated process. It is not an invitation for a collection agency or legal practice to disregard reasonable communication requests, repeatedly bombard someone with calls and then refuse to properly engage with the circumstances. And to Nedbank: you appointed Brooks & Luyt to represent your interests. Their conduct reflects directly on you. If this is the firm you have chosen to deal with customers who are attempting to resolve their indebtedness through an agreed debt-review process, then you need to take a very hard look at the people representing your brand. If you cannot ensure that an agreed arrangement is properly respected and that your appointed attorneys communicate professionally with your customers, then you are no better than the organisation you have appointed to do the job. Frankly, my experience with Brooks & Luyt has been unprofessional, disrespectful, frustrating and completely unacceptable. If this is how Brooks & Luyt conduct themselves when dealing with someone who is actively trying to resolve their financial obligations, I can only say to Nedbank: Good luck. You are going to need it.

Wrong person, continuous harassment

A person with the name of Mnisi has used my cell phone number, and he owes money to MoreTyme which they are trying to recover. These people continuously harass me, calling and sending SMS's. I have called in repeatedly asking them to remove my number and that I am not Mr Mnisi, to no avail. Each time I am told they will ask IT to remove my number. Not sure how this ****gery is tolerated
