Unacceptable Service.... Say something do something else..... Lack of response.

My account was handed over to Brooks & Luyt Attorneys by FNB when I couldn't meet my monthly obligations due to being unemployed. We agreed on an amount that I could afford to pay. I have not been able to increase it and I explained that to the consultant when then called last year. I've always paid my account on time. The agreement was that I would make payment by the last working day of the month.

In December 2016, I received an sms about a summons being issued by the courts. I called in to enquire why this was so as I was making the agreed payment and I was told by the consultant that this was a computer error and that all their clients received this sms and that I didn't need to be concerned because I would not be receiving the summons. On 3rd March 2017, a Combined Summons was sent to me. It was dated 02 February and stamped 28 February by the Civil Court. I never received an sms about it before it was dispatched. It was just sent to me unannounced. When I enquired why, I was told that other clients who also kept to their payment agreements were receiving summons and it was procedure required by FNB. I was told that as long as I kept making my payment obligations, I would not receive anything further unless I defaulted and they would inform me of a default judgement, etc. They also said that my calling in was me responding to the summons and that I did not need to do anything further. I requested for a response in writing acknowledging that I responded to the summons from 3rd March 2017 and to this day, I have not received it even after speaking to the consultants.

I even spoke with a manager on 15th March and he was going to send me something in writing after listening to the recordings but todate nothing has been sent. Yesterday, I received an sms saying that they would approach the court to grant judgement and the day before they sent me a reminder about my payment due on the last working day of the month. I called in and after lodging my complaint and being very frustrated with the lack of response that I've received, I was told that I am not paying the require amount which is supposed to be 10% of the O/S balance. How do you pay what you can't afford? After 27 minutes of explaining to and fro, I was told that it was escalated to the respective manager and that he has 1000's of queries like this to attend to and that he can't put pressure on him to sort out my query which is now close to a month being unresolved even though I've made this request from 3rd March 2017 and with this respective manager on 15th March 2017.

How does a company as such not show any interest? If they can't get what they want then they go to extremes. I've dealt with other lawyers and have not had issues as such. Brooks and Luyt attorneys are the ONLY ones behaving this way and it reflects very poorly on FNB.
