ABUSE OF LEGAL PROCESS

In Aug 2016 I lost my job and ended up being unable to service my Truworths account. I am still unemployed and unable to make payments towards the above account. The past 5 days ( 9-13 July 2018) I received an average of TWO PHONE CALLS PER DAY from Brooks and Luyt Attorneys regarding the above debt. I explained over and over again that I am still unemployed and cannot make any payments towards this debt. Today I asked the call centre agent who is liable for the costs of these phone calls. She informed me that I am. It therefore appears that Books and Luyt are DELIBERATELY adding UNNECESSARY LEGAL COSTS to my existing debt as it is OBVIOUS that my financial situation will not change in 24 hours and it is therefore POINTLESS to contact me TWICE A DAY. While i understand their obligation to their client (Truworths) this behaviour amounts to an UNADULTERATED ABUSE of legal process.

We refer to the complaint received on 13 July 2018 and hereby confirm that we act on behalf of Truworths.

We further confirm that the matter has been escalated to the manager overseeing the respective portfolio for investigation.

We will be in contact with the complainant in an attempt to resolve the issue and trust that this matter will be resolved amicably.

I also intend escalating the matter. I shall bring this matter to the attention of your client - Truworths myself and shall also be obtaining a legal opinion regarding same from your provincial Law Society and other relevant regulatory bodies. Not only are your incessant phone calls irritating and unecessary but they are also ******* if the sole purpose is to inflate the debtor's legal costs.
