Miss lead, mechanic negligence

Took my Golf 6 gti in for a software update.was **** to that a software update had been done.left car with half tank fuel finished my petrol and damaged the gearbox. I'm very upset I've been **** to and now I have a non running golf GTI i have not agreed to them even driving the car
