BMW 320D F30 SOLD WITH WORN OUT PARTS

I bought a BMW 320D F30 ( 88 000km) from Audi Menlyn on the 15th of October 2020.

On the 2nd of January 2021 I started hearing funny noise coming from the engine.

On the 27th of January I informed the sales consultant about the strange noise coming from the car.

On the 3rd of March I took the car to BMW North Cliff for Oil service and the following assessment was done:

1. Front Brakes Pads needs to be replaced ( wear and tear) 2.Replacement of Complete Throttle ( wear and tear)

I then Informed Riaz that BMW North Cliff is quoting me on the replacement of these items to which he advised me to bring the car to Menlyn where QC was done and the throttle is covered under the warranty I signed.

On the 16th of March (109 000km) I took the Car to BMW Menlyn and assessment will be done and warranty to be claimed. BMW Menlyn then confirmed that also the rear and front brake are worn out and need to be replaced.

I went to Audi Menlyn to see Riaz since there was no guarantee that I will be getting my car on the same day as I had driven from Roodepoort,Johannesburg to Pretoria. I was interested in knowing how did the car pass the QC with parts in the car at the end of their useful lifespan. In two months the throttle is worn out, the brakes are worn out.

The Motorplan schedule indicated that on the 21/04/2020 ( 85391) _front Axle Brakes - Squeaking unpleasant , Rear Brake Pads worn (and feeler). The same problem was identiied on the 24/10/2019 ( 75826) , that's in six months interval and mileage of 9565km's. I checked further that on average the throttle can last up to 75000km, There is no history if the throttle was ever replaced.

I then asked Riaz if the garage can arrange for courtesy car as I had to go back to Johannesburg, he said he can't help me with that and only the warranty claim will help me not the garage. I called the after sales department and a consultant promised to call me on Tuesday ( Have not received a call), On Wednesday I called again the manager Andries promise to call me ( its 24hrs now, still no feedback from the garage).

My car is still at BMW Menlyn as they are awaiting approval from the warranty insurance to approve or decline the claim.

The QC report I obtained does not specify items which were inspected as it was generalized and the is no conclusive evidence that either the process was flawed to allow for worn parts to form part of the sale agreement. The agreement seem to have been concluded in bad faith.
