Sold me a ****!!!

I bought a cellphone from a supplier on BIDORBUY called #touchthefuture. The seller assured me it was legit but when I received the phone it was evident that it was a ****. When i approached the seller for money back, they assured me they were not aware of that it was a ****, asked for evidence (which i got) and sent it back. After numerous emails back and forth, I am still waiting for money to be paid back after a year!! they keep saying they have not been paid yet. i have threatened them with small claims court to which they respond no. where do i go from here? its a lot of money!! all bidorbuy did was give me their ID and blacklist them on their site
