Shocking "Buyer Protection" - Incorrect Item Delivered

I ordered, and paid for, an item via the Bid-or-Buy site from a company called Zone Worx (would not touch them with a barge pole agin) on 01-Jun-16. The incorrect item (materially different) was delivered on 06-Jun-16. Despite numerous emails and phone calls to Bid-or-Buy & Zone Worx (who never responded nor answered phone calls after the initial one), no resolution to the problem was reached nor did there appear to be any chance of a resolution.

As such, a “Buyers Protection Claim” was opened on 24-Jun-16 in terms of Bid-or-Buy’s advertised;

“You're covered up to 100% in the unlikely event that something goes wrong with your purchase on bidorbuy. We will protect you if a seller does not send you the item you purchased or if the item is materially different to what was advertised”.

I am now being asked by Bid-or-Buy to ship the incorrect item back to Zone Worx with no guarantee that these costs will be refunded. I am not prepared to do so with the total lack of trust that has been generated. Send me the correct item and I will hand the incorrect item back to the courier. I had already placed my trust in you by paying upfront. It is time now for you to restore your credibility.

It has become a matter of principle, words the lawyers love to hear, as thankfully the cost of the item was relatively low.

As such, I am going to write this off as a bad experience and not have any further dealings with Bid-or-Buy, nor Zone Worx, as the reward outweighs the risks and has none of the benefits of shopping online. Hopefully other folk will do the same as with enough groundswell, firms like this will eventually work themselves out of the market.

I have attached my “choice” response to the matter from Bid-or-Buy below;

Posted on: 24 June 2016 12:16 PM

Dear Peter

The seller has failed to respond to my mails with regards to the incorrect item received. Her account has been restricted from selling and will remain restricted. We therefore suggest that you take the matter to Small claims court in order to resolve the matter.

Thank you very much. Have a nice day.

Kind regards,

Natashja van Zyl

Customer Support Team Leader

Posted on: 24 June 2016 03:08 PM

You’ve got to be joking with your puerile response “We therefore suggest that you take the matter to Small claims court in order to resolve the matter”. As per bid or buy’s claim, viz,

“You're covered up to 100% in the unlikely event that something goes wrong with your purchase on bidorbuy. We will protect you if a seller does not send you the item you purchased or if the item is MATERIALLY DIFFERENT TO WHAT WAS ADVERTISED”

I will now be submitting a Buyer Protection Claim as all criteria have been met, viz,

1.) Get in touch: First contact the seller to try resolve the issue.

Done - Emails (2 off) and phone call (06-Jun-16). Further follow up phone calls were not answered.

2.) Not resolved? If the seller does not reply within 3 days, please contact us.

Done – Various emails and messages on Ticket #UZA- ********** 3, the last being yours (09 to 24-Jun-16).

3.) Your money back: If we can't help you resolve the issue, you can submit a claim.

My next step following this reply.

Furthermore, please do not tell me to “have a good day” when clearly it is turning out to be a bit of a pain.

Regards,

Peter Kemp
