AA Damaged My Car in Sep 2018 and Still Hasn't Paid for the Repairs

My car had an overheating problem and needed to be towed from my premises to my auto mechanic’s workshop for repairs. I called AA whose premium member I’ve been since 1997 and they’ve sent AutoHaus, their subcontractor, to tow my car. When the tow truck arrived to my auto mechanic, the tow truck driver released all the safety measures that secured my car except for the front chain and started to lower the ramp. The driver was busy shouting on his phone the whole time, therefore he did not notice that his truck started to roll downhill towards the generator next to the entrance of the workshop while ramp was still lowering and shifting to the left (looking from the front of the truck) at the same time. My car started slipping from the ramp to the side that ramp was leaning on, and was thrown from it from the height of approximately ½ meter. The front chain jerked my car and managed to stop it from being catapulted into the workshop. The ramp then hit the concrete base of the generator, knocked the workshop sign in metal frame which fell onto my car and damaged it’s left front side. I reported the damage to AA immediately by phone, then sent them an eMail with the photos of the incident that my mechanic took, as well as his report of how it happened and what the damage was as per his initial investigation. I was also shown exactly what happened and where when I came to collect my car after the overheating problem was fixed. I insisted on AA sending their assessor in order to avoid any misunderstanding in regards to the damage. Their assessor came, took photos and wrote the report. AA accepted full responsibility, both via telephone and in eMails, for the damages to both me and my auto mechanic, as well as the cost of the car hire during the duration of the repairs. I was then promised that everything would be resolved speedily, efficiently and with the least hustle to me. AA first tried to impose AutoHaus, the same company that damaged my car, as the people to fix my car, but I refused to have any dealings with AutoHaus considering how good of a job they did in towing my car! AA tried to suggest AutoHaus to do the repairs again later in the process, but I refused for the same reasons. I emphasized to AA that I pay my membership to AA, not AutoHaus, I do not know AutoHaus for a bar of soap, so to say, therefore AA is responsible to me for sending the subcontractor that was careless, to say the least, to my property. How AA is going to resolve the matter with their subcontractor afterwards has nothing to do with me. I was then asked to go to the workshops personally and collect 3 (three) quotes, which I did on my own time and expense. Prior to the quotes, I did the suspension problem further investigated as suggested by AA’s assessor in his report, thus the repair of that issue was included in the quotes. I submitted the quotes to AA as soon as I got them together with all other documents required, and they picked the cheapest quote, which I agreed to. I was told that everything is in order and they were just waiting for their claim officer to sign it off, but she was away. We waited for her another two weeks, but her approval never came. Instead, I got a call out of the blue from some other people claiming that they were assessors assigned by AA to assess my car damage. I told them that the whole process was finalized and that there was no way we were going to start it all over again already two months in it. I also told them that they should tell AA to call me and inform me what that was all about, considering AA should have not given my contact details to some random company that I have never heard of without my consent. AA never called, so I send them an eMail again to see what was going on. Instead, I got a call from Murdoch workshop, the “winning” quote, that they were told by the new assessors appointed by AA (people that called me) to book my car in so that they can assess it (again!), then Murdoch would do the repairs as per that new assessment. I told them that nothing has been agreed with me and that AA broke the same procedure they’ve told me would be followed. Murdoch then forwarded the eMail they’ve received to me. The eMail was from the new assessors and was copied to all the relevant people in AA, but not to me, directly affected party!!! My car is supposed to go in for repairs, but I am not to know about it!!! I’ve sent another eMail to AA asking them for full explanation regarding the discussing and unprofessional way that they are treating my case, opposite of everything they promise and what the decent business practice should be. I was then ignored by AA for quite some time and did not know what to do and how to get them to honor their responsibility and promises. I was telling everybody about my ordeal and asking them for advice what to do. It happened that one of my friends knew the CEO of AA, Mr Collins Khumalo, from his previous position in MultiChoice, and she offered to contact him and ask him for help. The following day I’ve got the call from Mr Noelan Vandayar who was to help me as per Mr Khumalo’s request. I’ve told Mr Vandayar the whole story. He was seemingly horrified by the way I was treated, apologised to great lengths and promised immediate resolve. I thought: Thank God, finally!!! Little did I know! I was then sent the Release form never mentioned in any of our previous communications, which clauses and wording were totally unacceptable, specially the first paragraph that stated that AA is responsible just for the exact amount of Murdoch’s quote (the amount was stated in Rands and Cents exactly!), the quote that was by then almost 2 (two) months old and not valid any more. There were other provisions there that made it impossible for me to sign, therefore I’ve sent it back to be changed as per my suggestions. AA refused to change almost any of it, including the most important issue being the amount of repairs that was not even valid any more. I then suggested the new draft of the Release, the one that we could both be happy with, starting with the suggestion we should get the new quote from Murdoch. That eMail was sent from me to AA on 21 November 2018. Nothing since then - they neither responded to my eMail nor contacted me in any way. They are ignoring me for more than 2 (two) months now! They did pay the damages to my auto mechanic though, few weeks ago, I think, but not to me! Unbelievable!!! I am AA’s loyal member for 22 years now, paid my membership fees diligently (I estimated I have paid AA approximately almost R30 000 in membership fees so far!) and barely used their services over the years, so for them to treat me and my valuable property this way is thoroughly disgraceful and absolutely unacceptable. I have reported this matter to Consumer Goods & Services OMBUD, and, if that does not help, will have to engage lawyers and go to Court.
