Bad Service

I purchase a vechicle in July at Autopedigree in Strand Cape town. It was preowned Ford Figo 2015 model. The car was delievered on the 10 July 2020 at about 17h30 0n rainy day.On the 11th morning got up excited and went to have a look at my car. It was a beautiful morning.On my inspection i pick up some defects such as scratches,there was some untidy paint work on the boot and door and it brought concern since i was told by my salesman,its a good second hand car and it was a ladys car,well cared for and i was a second owner.I immediately sent my salesman a whatsup message informing him about the defects and even later called him.He said he will get back to me on Monday. He never came back to me and on the 15 my hubby called them and said will come back to us. I took the car on the 17 July 2020 for inspection and it was found that the two front wheel thread are thin,the break light at the back was not working.And the battery charge is 27 percent.I informed the dealer and said okay will come back.Also the colour of the boot is cream and the other part of the car is white.The inner front door also is rusted and with Cape town weather and have a car with rust.Inside the , and paint work on the inner surfaces.I escalated the situation to the head office and they came fetch the car in the 22 July 2020.I told them i dont need the car anymore they should return the finance to the bank. I was told a day before delievery that it was at the Recorn for a bumper,and one moment i wander why but forgot ask because initially i was told the car is perfect.I believe in my salesman because he was very promising,well spoken.My biggest mistake i trusted him so much that did not question much. They were more interested in sorting the defects but after so many days trying to get them to sort the problem.,I was no more interested,lost trust. I took the matter to Obudsman on the 29 July. They sent them letter regarding my case and expected a response on the 18 August which the company did not respond .I again contact Obudsman via email and telephonically about the progress. They sent the dealership another email and gave them 3 working days to respond which was suppose to be on the 13 September and still no response. I called Obudsman and they said they still busy with the case.I need help in this matter.Complain was logged in July and now in October and i am payng for a car thats not in my possession. I am very frustrated because this case is stagnant and every month the debt order is going,paying for something thats not in my possession.I need to move on

You have logged a complaint with the Motor Industry Ombudsman of South Africa (MIOSA) and they have ruled as follows:
 
"We have assessed the submissions made by both parties involved and all the documents forwarded to this office. It must be noted that in terms of the Consumer Protection Act 68 of 2008 section 56 subsection 2 states that there is a six months imp**** warranty after the delivery of any goods to a consumer. The respondent acted in line with the above mentioned section of the Consumer Protection Act 68 of 2008 by attending to all the concerns reported by the complainant within the six months imp**** warranty period.

With the above in mind, the Motor Industry Ombudsman of South Africa is satisfied that the respondent in accordance with section 56 subsection of the Consumer Protection Act 68 of 2008 and as such we cannot support the expectations of the complainant as stated in her submission for a deal cancellation. It is the recommendation of this office that the complaint should make the necessary arrangements to have her vehicle collected if this has not been done already.

 Should the consumer decide to lodge a complaint with the National Consumer Commission (NCC) a copy of the MIOSA case file, free of charge, will be supp**** to the consumer which must be filed with the complaint at the offices of the NCC. In the event of no further communication being received from the consumer within 7 days from date of the recommendation letter the MIOSA file will be closed. "
