Good day I recently entered into an instalment sale agreement with Audi Centre Johannesburg whereby I traded in a H100 bakkie 2015 model for a VW Kombi T6 2016 model which was advertise on the internet. Through one of the sales agent Christo Barnard on 20 December 2017. I forwarded the required documents on 22 December 2017 including an offer to purchase (OTP) from the previous dealer for a deal that did not fall through, he later indicated that they will match the offer and settle the outstanding amountof which they did.
On 27 December 2017 he sent me an OTP with the vehicle price of R 368 377.19 (vat exl.), on the road fee of R 3500 balance payable of R 423 940.00 (vat incl.) I indicated to him that the vehicle was advertised at R409 000.00 He assured me it will be sold to me at R409 000.00. I requested to pay the on the road fee in cash as I didn’t want it to be financed. He came back later and indicated that he spoke with his Manager and they came into a conclusion to remove the fee completely I do not have to pay for it.
04 January 2018 we met halfway in Middleburg as I'm from Nelspruit for delivery of both vehicles, The Agent (Chris Barnard) produced a contract which included the on the road fee and the principal debt was now R411 147.00 He indicated that he left the amended contract in the office but it will be sent to me once I sign the agreement he had, He gave me a new OTP with the vehicle price of R 359 605.26 reflecting a plus and a minus figure of R 3500 on the road fee which brought the balance payable to R 409 950.00 as agreed.
After signing the contract back in the car my wife noticed that the door locking button on the left side sliding door of the car was missing, He took an undertaking that he will courier it to us as the guys at the dealership were performing the pre-delivery inspection and forgot to put it back.
The following morning of the 5th of January 2018 I also noticed a poor workmanship on the front bumper of the vehicle I investigated it and suspected that the car was involved in an accident I gave Chris a call to my surprise he confirmed it and told me to get a quote he will fix it of which I obliged and e-mailed it to him. On the 8 of January 2018 he told me the trade in vehicle was sold and I have to resubmit a copy of my ID and drivers licence to register the Kombi and for the bank to pay the dealer for it, I once again sent it via e-mail.
On 15 January 2018 the debit order amounting to R 5 031.50 for the H100 Bakkie that I traded in was deducted from my account I immediately brought this into Chris's attention once again he made another undertaking that I’ll be refunded by the dealer I must sent him my banking details days went by and I started to engage him on the undertakings he has made to me as they are piling up each day and requested all documents that were due to me that includes the following • The copy of the reviewed Sale agreement • Copy of the signed OTP. • Pre delivery inspection/safety check report • Quality check report Natis report • A detailed report or copy of the invoice on the work that was performed on the vehicle
On 31 of January 2018 he indicated that the guy who bought the trade in vehicle (H100) wants a discount of R 10 000 so i am responsible for it because the service history in the vehicle is not up to date and indicated that the calculations will be as follows: Service history R 10 000.00 Kombi repairs (R 3 705.01) Balance due to JHB Audi R 6 294.99 He requested me to advise him in this matter and I indicated to Him that I was not an except in that field therefore I cannot assist him neither interfere in matter relating to his clients I strongly believe that the vehicle should have went through all this inspections and tests as it is enforced by the franchise agreements between the dealership owners and manufacturers that every car you sell has to be inspected to ensure it conforms to basic roadworthiness criteria, in certified pre owned cars has to be taken to the relevant agents and certified to conform to their manufactures’ specification.
Upon my inspection in the sale agreement I discovered that the contract was also frudulantley amended and the financial implecations is as follows:
On the road fee is R 25 830.00 which is calculated as follows (R 3 500 *10, 25%*72 months) if it is financed
The trade in vehicle H100 was deliberately delayed and settled on 19 January 2018 after the debit order of R 5 035.00 had gone through on 15 January 2018 in my account it was settled for R 154 981.93 instead of R 159 605.37 as per our agreement on the OTP.

As at 03/03/2018 I am unable to renew the licence disc and register the vehicle under my name as it still bears the GP registration and I am in Mpumalanga, I contacted the MFC on this but the Bank also does not have the original or a copy of the certificate of registration of vehicle (Request was made with one of the MFC Agents Mr. Gordon Ngutshana 0n 02/03/2018).
As at 08 March 21018 the situation is as follows: The Bumper still needs to be fixed On the road fee of R 3500 has not been removed and still forms part of the sale agreement with the financial implication of R 25 830 .00 . The instalment of R 5 031. 50 for January not yet refunded nto my account. The dealerstill owe me the following documents. Pre-delivery inspection/safety check. Certificate of roadworthiness Quality check report Copy of certificate of registration of motor vehicle. A signed copy of the offer to purchase (OTP).
A detailed report or a copy of the invoice on the work that was performed by the vehicle by the panel beater who fixed the vehicle and other related documents that I am not aware of.
Numerous attempts to get hold of the Dealer Principal (Mr. Brett Hudson) were telophonically made but however i was unable to get hold of him and He was unable to get back to me with regards to this an E-Mail was sent to him on 14/02/2018 detailing all my queries, a lady by the Name of Merriniquer Rubens who she indicated that she was task by the dealer principal to resolve all matters relating to my query responded telephonically on 15/02/2018 howeveras at 13 March 2018 nothing has been resolved accept for the roadworthy cerificate, sales agreement and a copy of the signd offer to purchase.
