I purchased a 2017 Gold BMW M3 Stock number *** from Auction Nation under the explicit advertisement that the odometer reading was 120,410 km. Before taking delivery, a formal check on the official BMW dealer system revealed that the vehicle's mileage was already recorded at 155,503 km back in 2024. This is an indisputable, ******* odometer reversal and gross ********** misrepresentation under South African common law. I immediately raised this ***** with Rikus Booyens and Steyn Bern at Auction Nation. They chose to completely ignore my messages. I had to message them again just to get any feedback, only to receive a lazy, cookie-cutter response claiming the car is sold "as-is". Let me be completely clear: under South African common law, an "as-is" (voetstoots) clause is legally void in instances of ******** ***** and intentional concealment of defects. You cannot use a disclaimer to sell a vehicle with a tampered odometer. I have formally refused delivery of the vehicle, and it remains at your yard. Since Rikus Booyens and Steyn Bern refuse to professionally address a case of odometer *****, I am posting this publicly. I demand immediate cancellation of the transaction and a full refund. My formal Letter of Demand has been sent, and if this is not resolved immediately by senior management, a ******** ***** case will be opened with SAPS and a dispute lodged with MIOSA.
