Poor Performance in Holding Trustees Accountable to the Sectional Titles Act and CSOC
The managing agent (MA), Natasha who was responsible for the Sable Body Corporate, Noordhang, Johannesburg does not challenge the trustees of the complex ensuring, that decisions are taken in line with the Sectional Titles Act (STA) and the agreed complex conduct rules, which has been to the determent of the complex which is ultimately the owners.
The MA allowed the trustees to delay a common property repair from March 2023 until December 2023 /January 2024 and the repair was only carried out due to the case having been taken to CSOC for adjudication. Note: With the delay in carrying out the repairs, repair costs have increased, and this type of cost is ultimately carried by all owners.
Further to the above, the MA and trustees allowed personal information to be included in public documents, despite clear communication from CSOC stating that the information was confidential while the case was in progress.
Further to the above, the MA and trustees have been reported to the Informational Regulator and have been found to have overstepped the line pertaining to the above and to date have still not closed the matter out with the affected parties - 12+ months later. Note: The MA issues a letter not even on an official letterhead. This shows lack of professionalism to all parties including to their own organization.
Been a MA and /or trustee/s is far from a popularity contest and requires difficult decisions to be made in the best interest of the owner/s investment/s.
