Ark rental car failed to assist me in tracking the 3rd party that hit me and ran while I was driving their rental car
Ark rental car failed to assist me in tracking the 3rd party that hit me and ran while I was driving their rental car. With the help of the car guard, I was able to open the case with Meyerton police and the perpetrator was apprehended. The perpetrator's insurance took the matter up with Ark Rentals Car. I was made to pay the excess amount of R5 400 and promised to be reimbursed once the 3rd party pays. Today, I followed up after been sent from pillar to post only to be told that I am liable for the excess amount and my question is how so when I did not cause the damage to the car? Why is the amount not demanded from the 3rd party who even fled the scene?

As per the rental terms and condition, the renter remains liable for the excess even if the third party admits liability or is proven to have caused the accident. Ark Car Rental will endeavor to recover damages from the third party, and only once full and final settlement is received will the excess be refunded. Clause 6.2.6 states that if legal costs outweigh the damages recoverable, Ark Car Rental may stop the recovery process, in which case the renter forfeits any claim to a refund of the excess.
