Rejection of motor vehicle insurance claim

Good Day, I would like to share an experience we have encountered with the above motor vehicle insurers.

Rejecting a claim on the basis of certain personal records which they acquired without the consent of the policy holder. The contract between the insurer and the insured makes no mention of their right to automatically acquire personal information on the insured. As the Protection of Personal Information Act is not yet in force and there is therefore no clause in the contract, the insurers acted on gaining this information without consent of Insured.

We are now going to lodge at Ombudsman.
