Incorrectly Repudiating Claim

On 12/06/15 I had a truck suffer catastrophic engine failure after the protective sump cover hit the road while the vehicle was moving forwards. I originally suspected that the sump cover falling down was a result of defective workmanship on the part of the dealer who did service 2 days prior.

On the 18/06/15 I submitted a claim to IUM after an extensive report conducted at the scene of the breakdown by the vehicle manufacturer that proves that the damage to the cover was caused during the normal course of operation.

IUM sent an independent assessor to the truck who produced a report stating that in their opinion it was not an accident and put the blame on the dealership.

Since then, I have ordered independent reports from the Retail Motor Industry and separately a report from an internationally recognized forensic accident investigator who specializes in mechanical damage.

In a nutshell, 3 reports produced after 3 separate and independent investigations proves that it was accidental damage and our insurance should pay out. Even after submitting these 3 reports to David, via our lawyers, no valid or accceptable action or response has been received. Loosing 48,000 weekly!!!!

Hello Erickrige,

We have a report showing that without any doubt, this incident occurred as a result of a failure to secure the sump cover. There were bolts missing, it was hanging down and folded backwards and up into the oil pump area. The damage could not have happened in any other way.
We have sent our expert's report to the client, but we have never seen the three independent expert reports he refers to. If we see these reports, we would be in a better position to respond.
The case is with Mr. Kriege's attorneys, who have been responded to.

Best regards,
