3rd party claim not paying out

on the 23rd of March Mr Ellis reversed into me while coming out of a parking spot, I had driven into the Engen and another car was behind me, I stopped and waited for Mr. Ellis to drive off but he failed to stop and I could not move, he had 2 car lengths between us but just continued to reverse, he did not see or hear me and apologised, gave me his insurance details, his brokers are: Select Brokers, his brokers name is Izelle Erxleben, his insurance is: IUM (Insurance Underwriting Managers) Pty Ltd, their lawyers are: Jayne Macaulay from, Arangies Inc Attorneys, who are unfriendly, uncomplicated, and truly unhelpful and rude, Mr Ellis even showed me his drivers license, no body was hurt so we went on our way, I put the 3rd party claim through his insurance as I couldn't afford the R5000.00 excess and now the 4th of December 2018 after calling and emailing and more calling I finally get told by his insurance companies legal team that they will not be paying out as I was at fault. This is absolute nonsense, how the hell was I suppose to get out his way with cars behind me. He admitted he was at fault, he apologised, I have 2 witnesses and cctv camera footage can be obtained from Engen.

With reference to your complaint received on the 04th December 2018.
The matter has from the onset of your claim been investigated with our attorneys. We have however again discussed the matter with them and they will be in contact with your shortly. 
As with any other third party claim there is however certain checks and balances that need to be followed. We have noted that you made mention of video material and independent witness statements , please provide our office with this.

We have reviewed your complaint and advise as follows:
 When the incident occurred between you and our insured you opted to lodge a third party claim instead of lodging a claim with your own Insurer. Your Insurer could have commenced with a third party approach against our insured and your vehicle could have been repaired as per your expectation. With third party claims, various factors and evidence will be taken into consideration before a settlement is proposed.  Taking into account the apportionment of damages and factors to your claim, a proposed settlement was presented of which we viewed as fair and reasonable. The questions surrounding your complaint is based on initial evidence provided and as you have alluded, you are in possession of additional evidence that could have strengthen your case. We have provided you the opportunity to present the evidence in order to re-assess your claim.
