Debt review agency so *********** they may cost me my house
I signed up with this company r in February via a phonecall from marketers, but they have messed everything up so badly for me that now the bank wants to take my house.
I made payments as per their instructions to a bank account they gave me. When I queried why nothing was being paid, they told me about the fees etc & to continue paying. I specifically asked if I must pay to the same account & they said yes. This was their own account I have found out, which means that the 3rd payment that was meant to be distributed to my accounts was not picked up by Hyphen DPA & as a result, all the people I owe money to thought I had defaulted on paying & were phoning to tell me I was no longer on debt review.
The owner of the company, Alfonso Pedro, eventually spoke to me on the phone & apologized & said they should have changed the 3rd payment to the PDA account. He claims he manually searched for the 3rd payment & paid it out, but I have never received any statement for this. He also promised me an invoice from their lawyer for the 2nd payment of R19000, but I have not received this either.
I have continuously sent them copies of emails/letters/sms's that I receive from my accounts for them to follow up on, but they never reply to me or let me know what's going on. When I phone, the man dealing with my account, Rudi, is never in the office, & Alfonso is always out or in a meeting.
Last week I received a phonecall from a lawyer here in Port Elizabeth to say that the bank has terminated my debt review for the home loan - which I never wanted on debt review in the first place. I immediately let APAssociates know. I have now been receiving receipts from Hyphen DPA, but when I opened them, I am still paying their lawyer, Byron Koopman, R6400 a month, after apparently paying him R19000 already! Which means there was very little left to pay other accounts. I don't know what action they took on my email as 99% of the time, I receive no reply at all, even if i get a read receipt which I attach to each email.
Last week another lawyer contacted me, Mr Classen, who asked that I send the confirmatory affidavit through to him as it was still unsigned. I asked him what this is as I have not received anything before. He informed me it should have been done ages ago. I am unsure of why this lawyer is now involved & what happened to the original lawyer that I have paid so much money to.
On Tuesday, they phoned me to tell me to sign & send another Form 16 to them which they had emailed to me. When I asked why as I had already done this, they could not answer me. Mr Classen was also there & asked that I send it through as quickly as possible so that he can lodge papers in court.
The home loan lawyer asked to see me, which I did yesterday. He informed me that he has been instructed to attach the house. The bank requires an amount of R64000 for this to not happen. If I had that kind of money, I wouldn't need debt review. I phoned APAssociates as soon as I get home. Obviously Alfonso was not available & I asked that he contact me by 9am this morning as I have to let the lawyer know what is happening. Needless to say, I haven't heard from anyone. I have tried phoning them, but have not been able to get through. I specifically asked in one of my emails if Standard bank was happy with the loan arrangement, but no one ever got back to me. Despite me telling them repeatedly that I'm apparently no longer on debt review, they did nothing about the situation. Now I may lose my house because of this. I paid every month as I was supposed to, but they have messed all the payments up. Mr Classen now tells me after I queried the payments to Byron Koopman, that I am due for a refund because it was an error.
I am also paying one of the accounts over R3000 according to the statement, but my original payment was R2088. I have also queried this, but no one replies. I send at least 2 emails a week to them with everyone that is telling me I'm not on debt review any more & demanding payments, & they literally never respond to me, either by phone or email.
I don't see why I should lose my house because of their incompetence. The STD bank lawyer said they need to approach STD bank & explain & hope that the bank will accept what happened & allow me to go back on debt review with them.
The company is Alfonso Pedro & Associates in Cape Town - https://ap-associates.net/. I strongly urge that no one ever deal with this company, unless you want to lose everything.
